I'd been a happy Secondipity customer for years and vouched for them here on SD (see post history), but they've adopted new, consumer-unfriendly policies. Reports that they're sending items that aren't actually refurbished, rejecting returns, and banning customers who return are 100% accurate.
My last couple purchases didn't meet condition criteria. Got a Sony AZ3000ES receiver ($1000 item) with stickers on it and a sizable dent to case. They claimed it was in acceptable condition for a refurb and made no effort to address the issue other than suggesting I return it. Then they refused to provide a paid return label because they claimed no defect. When I left negative feedback, they banned me as a buyer.
See the last update on the OP regarding the XM5s reportedly having similar issues. I've personally had to replace the batteries in my XM4s 3 times and still seem to have battery issues. I get about 90 minutes out of my right earbud even after replacing the battery only a few months ago, even after updating the firmware.

Just sent my XM4 to AllState a 3rd time for battery issues. I don't even think they do anything with it and just return it back because they just get so many like this.
Sony would refuse to repair refurb earbuds even if you offer to pay. Your only hope is for the bricking to take place during your eBay warranty period.
