edit: I speak from my experience dealing with Sony support for a refurbished XM4 I bought from Secondipity.
I also have the over the head xm4 that I bought brand new and never had issues with those.
See the last update on the OP regarding the XM5s reportedly having similar issues. I've personally had to replace the batteries in my XM4s 3 times and still seem to have battery issues. I get about 90 minutes out of my right earbud even after replacing the battery only a few months ago, even after updating the firmware.

I think the best course of action is if you jump on this deal, set a reminder a couple months before 2 year secondipity warranty expires and simply file a claim if you need to. Also, once you are past 2 year warranty, simply never update the firmware again. Or if you do, let that version marinate in the market for a month to make sure there is nothing wrong with it before attempting.
I also like to think so long as the XM4 firmware bricking update wasn't intentional, it's unlikely Sony would want this to happen again. Having a fatal firmware update on two successive generations is reputational suicide.
I think the 25% smaller, 20% lighter are the real wins. Also ANC is supposed to be superior.
Just sent my XM4 to AllState a 3rd time for battery issues. I don't even think they do anything with it and just return it back because they just get so many like this.
Right after, I purchased the xm4 headphones there & they arrived almost like new & still hold the same. Maybe I got lucky.

The pair I got were in great condition, looked new, included new buds and everything. They were connected to someone named "Andrew" previously though. I did a reset on them and everything looked really clean.
Even though I have a Pixel 8 Pro, I might just go pick up the AirPods USB-C Pros.
