No they can't. You are also not putting ATT SIM in it. BB is just selling you the phone with a phone plan, once you are out of the store they don't care. ATT can flag you but that's unlikely.

If you are being asked passcode for cancelling the account and you don't have one and also you can't set one as the 2 factor phone number is not active going to an ATT store is the best course of action. They can send the code to an email and you can cancel the account there.

- My online order was stuck in preparation.
- It was the second day today no update till afternoon.
- So Chatted with the ATT canceled lines and took a chance if BestBuy shipped it or not as I do not want to pay $95 X 2 for these phones.
- The account is 100% canceled at ATT I checked both ways and my lines from Google Voice are still intact (did not unlock the first time).
- Just got the notification that Phones are shipped from Bestbuy warehouse just 20 miles from my home and will be here tomorrow.

$45 restock fee per at BBY if returned is the only scary part but I don't believe any reason to return as long as the T account is in order.
Called att on their main customer line. Told them I cannot access my new account, and I'm waiting for a passcode. They wanted to send a confirmation number to my phone number which I'm porting. They sent the confirmation number to verify my account, which the number was a google voice number. From there they wanted the last 4 digits of the social. Finally the rep let me setup my passcode. I had to explain I do not have the phone and it will not ship from Best Buy without the number. Called Best Buy, with the ATT CS rep on the line to help (not needed but was helpful) and BB took the passcode number and shared the passcode info with the BB porting department. 15 minutes later, BB Called me back to let me know that it was completed. I then received the email to setup my account for ATT , and I could no longer cancel the phone in BB orders. Seems like things are back on track.
