The seller states the condition on each listing ,New, Pre Owned or Open Box.

I ordered 2 "new" items and neither were new. It's a crapshoot.

I got one a few weeks back and my 4 year absolutely loves it. Yes, it's fairly cheap plastic but we are talking about a big fun dumb truck with a trailer full of cars for $8.45. If anyone paid the full price I wouldn't blame them for complaining about that quality. At this price it's great.
