I'd assume these are just used items, and hope you get one manufactured recently and returned due to the buyer getting the wrong one (easy mistake to make given Apple's insane lineup of ipads and Pencils with or without dongles etc). While I generally have excellent luck with Apple stuff, I did have two Pencils randomly quit working over the years.... but at $38 it's probably worth a gamble, and perhaps it's possible to figure out the manufacturing date based on the serial to see if you got a fresh one.

The knockoff charges on the iPad via magnets, I can get the battery info, etc etc. for ~$10 it does a lot of what the official one does
Love my pencil but couldn't justify full price for my uses.
