Yes, they are now mostly. I used it to get the Circular Saw, Pruners and high speed ratchet. I just started building the M12 set. Used HD's liberal return policy to rid myself of most of my old batteries. If you're going to have a 'foot' sticking out the bottom of the tool make it a 5 amp. There's no reason to buy a 3, 4 or 6 amp battery when the 5.0 bests all of them in reliable discharge. Several test have proven it's the best and only reliable way to get the most out of your M12 tools.

I just started the M12 build up in Sept so mine are brand new. "Old batteries" for me meaning old tech, not old batteries purchased years ago. Ebay and store returns for me.

Home depot has battery drop boxes for old power tool batteries for recycling /disposal. In the spring ours usually has a trade in deal to knock a few bucks off new batteries.

Yeah now the only thing left is a 5.0 battery. So you can buy them separately for 59. Or get the package deal 2 and a "free" 5.0 for 198 haha what a rip that deal is. I could have used the pruner or transfer pump though.

I doubt that any Amazon sellers are authorized Milwaukee dealers. Their products may be fakes, customer returns, questionable refurbs, really old liquidated inventory, stolen, gray/black market, etc.

The warranty, if any, will go by the date of manufacture instead of date of purchase.
