OK I did a study on this since I bought fake Airpods Max from an eBay seller. I refused to return it since these MOFOs would just resell it to some other sucker. I bought one of these "Like New" and will be watching the detail on this to check. Here are the clues I used for an eBay dispute, so hopefully this helps someone else who's concerned:
1) Serial number may be a legitimate Apple serial (based on the lookup on Apple's site). This is highly deceptive and often confuses most people.
2) Box and headphones show many signs of counterfeiting. Here are some tell-tale signs:
- On box, the sticker at bottom of the box shows: Compatible with latest iOS and iPadOS devices, Apple Watch or Mac. IOS iPadOS, Apple Watch Mac. This last line is translated into 4 languages in the original and IOS is definitely not misspelled.
- OEM box has AirPods Max Sky Blue with Blue Headband. Counterfeit box as follows: Headphone Max Space Gray with Black Headband
These are not authentic AirPods Max headphones. They are plastic cups on the ear, not "beautifully anodized aluminum cups feature a revolutionary mechanism that allows each cup to rotate independently and balance pressure" (https://www.apple.com/airpods-max/).
- The LED light is blue and red when pairing, while legitimate Apple AirPods Max are actually amber and white. https://support.apple.com/en-us/119838
- A tell-tale functionality with fakes it does not support Automatic Switching between Apple devices (Bluetooth connect with two devices and hand-off automatically when playing music or video etc.): https://support.apple.com/en-us/104988

Whats there process for assuring the used product isn't a swap out with a fake? Do they validate authenticity somehow? I've heard these are notorious for that

I'll roll the dice on these. I currently have the Sony XM5's and I think I can sell them for ~$150 if these are in good condition and I end up liking them better.

This is my concern as well. Does Amazon check to see that someone didn't replace them with the many fake AirPods Max found on Facebook Marketplace? I think I would rather spend a little more and buy them new for $400.

Tons of fakes going around. People buy the genuine ones and swap them with fakes.
Even buying new doesn't guarantee that you'll get a real one.

You must mean "even buying new from co-mingled inventory doesn't guarantee that you'll get a real one." Right?

I mean, if you walk in to Target/Apple Store, and they are unopened, they can't be fake.
