It sounds like this is just like in the guitar world - where someone cleans out their stock but they can't sell it as 'new.' It's so the original retailer can get a sales bonus or hit some Apple related sales/marketing rebate quota.

Ended up getting one. Deal is just too good to pass up, especially since they're new. From the seller: "the Silver model is Bulk New, they are new but have been repackaged. The Silver model is the only one we had that was Bulk New, the Space Black was refurbished."
Did I really need it? No. But I had to move over to the Apple ecosystem due to family and work so out went Android/Windows, so may as well get this behemoth.

I have been debating this deal vs the Micro Center deal that was a 16in M4 Max w/ 48gb ram and 1tb drive for around $2900. It's really hard to justify $900 for slightly more ram and 1-gen newer M4 Max. Am I wrong about this? Help me justify spending more money.

Just received mine today (silver.) It arrived with a dead battery and the chassis and trackpad appear warped, as if the battery is swelling. The device otherwise appears to be in new condition. It does have an Apple warranty, so I am taking it to the Apple Store to be checked out.

I pulled the trigger on a silver one since Black was OOS.

M3 Max at this price is probably worth it if M5 Macbook isn't until early next year and the Macbook after that will be the redesign.
