I checked my local Microcenter in NYC, the Mario Kart was NOT scratched off. HUGE YMMV. Microcenter will allow you to open and check when purchasing if the code is scratched off or not.
That being said the Yonkers location for example specifies in their open box "Incomplete no Mario Kart" to not waste your time going to check.

Do these still include full manufacturer warranties? If Mario Kart isn't included, then it's only a $25 savings off the new price and imo the warranty would be worth the $25.

I have no idea, that would be up to Nintendo if they would validate a warranty claim or not. I got mixed answers on Google saying yes they will, or no they won't.
Edit: I think it's a good deal if you are getting a copy of mario kart at 425. Otherwise you could ask the store manager if they will discount it further. YMMV on that but I met some cool store managers, their job is to move inventory at the end of the day.

How can you tell if these are banned units when buying?
You would have to connect to wifi and see if you can access the Nintendo Store, you could just hook it up to your smartphone hot spot. Connect and check and go back into Microcenter right then and there and return it showing hey this is banned and they wouldn't question returning it.
