4/5 Amazon resale APPLE items were older versions or DOA, I still buy when a deal in case I get a good one, just do not trust them as a gift without testing.
Almost every non Apple items I have gotten on resale were practically new, maybe like 40 or so.

If it's genuine Apple, you can check the warranty when it's started, new version should start couple months but older version most likely out of warranty.
this or the apple pencil 2nd gen for iPad Pro 11 in 3rd gen?
Also how to figure out the fake ones since this is a like new (possible return and swap from scammers)?
If the fake performs and feels like the real thing, who cares? We have a $18 competitor, it's nice but you'd never mistake it for the Apple version. It doesn't show the charge level, not sure a fake would either.

I've had original and fakes. My fakes weren't particularly good so suggest you confirm online:
Branding / markings were incorrect. Mine didn't have the logo at all.
Functionality was drastically different. In some ways the fake was actually better for me.
My fakes (was a pack of 2) failed me after 6-9 months. That included big breaks in usage and I'm pretty sure it was the battery that failed. YMMV.
Anyway, on these a fake should be pretty easy to spot if you just take 15 minutes with it and google.

so fake or real, once the battery is gone, this pencil is a trash? like airpods?
I just received mine in the box with a new "non apple" sticker to seal the box. It looks perfectly new, not scratches or marks of use and it connected to my ipad. The tip has a golden mat finish as it should and it responds well when I use it on the iPad, so I'm almost 100% sure that it's an original, not a copy. Very nice deal!
edit: I'll add that the MSRP is $79.99 not $69, so it's ~55% off, not 47%.

Just received mine. It was listed as "Used - Mint" but had many chew marks on it when I opened it. So apparently they meant it was used AS a mint. Back it goes.
