I'm with you 100% in theory.
But this is supposed to be a "nutcracker", and while it still fails at even being that - nutcrackers generally have their hands down.

American consumer checking in after catching the stray. I realize this thing misses the mark on the nutcracker theme, but I don't see any problem with it for $4. My 3 year old loves Spidey and would get a kick out of this.
