Some states limit kids even more, like to ebikes capped at 20mph. NJ has banned ebikes for all unlicensed riders, after a kid ebiked into traffic and died. (And all parties voted for it. "Think of the children!")
Furthermore, this form factor is not good for a bicycle where you pedal. That big, wide seat? Yeah, that's crap for pedaling. Do you see any way of adjusting that seat for pedal comfort or power? Absolutely not. Notice how slack the chain is in the "action shot" on level ground. Not a great sign for keeping the chain attached.
Lastly, this "bike" screams "I wish I were a motorcycle." Triple-tree front end? Way too heavy for any bicycle. Oversized tubular steel frame? Same. Square seat in a fixed position? Only for 100% motor use. Big ol' eyeball headlight? Absolutely motorcycle-wannabe.
This thing all but has a sign that says "Do any cops want to harass me over my unlicensed e-motorcycle?"

I am a USAF veteran living in Montana, and our outdated laws have ebikes capped at 20MPH, Mopeds at 28mph , and the rest are required to be certified as an electric motorbike.
You are required to have a driver's license to drive a moped in MT (so some older middle schoolers may be able to drive a moped). And a motorcycle endorsement for an emotorcycle.

So...what state is this a street legal e-bike without a license? This is useful information for shoppers, knowing where a product can and cannot be used.
I'm not really FOR more rules, but I think that the only solution is to set universal ebike speed limits that can be applied to specific roadways just like cars. Due to ebike design. Setting power and type limits isn't gonna work. I'm 240 pounds... it takes a 1000watt controller to help push my fat ass up a hill.....so should I be denied ebiking because I'm big?

. I weigh more than you and have a 350w hub motor which will not push me up a hill by itself because the one gear it has is configured for 20mph on flat land. It does, however, make it a lot easier for me to pedal up hills. It is an e-BIKE not an e-motorcycle.
So cheap e-bikes will have some limit. We could accepting a lower top speed in a high torque configuration on cheap bikes with hub motors. That wont happen so it means the limitation is us meat-slabs have to do some of the work.
OR we pony up more cash for more expensive middrive bikes that can take advantage of multiple gears to get the maximum allowable speed on the flat land and still climb any hill at a slower pace.

Basically the electronics are very "okay'ish" on these. But could easly be upgraded if your into that. The frame, wheel and the sum of all the other components are well worth what they are asking. Very heavy frame as well. Its a decent starting point for a good DIY E-Motorcycle build.

It did not start as me saying randomly: "Hey I wish more cops would stop middle schoolers on these ! "
It was him (for some reason saying he was a cop), wondering what "code" (which it wouldn't be a code in any case) from stopping kids from riding these to another person's reply.
I said basically common sense should tell you (code or not) a 33 mph motorized vehicle for a small kid, probably isn't a good idea if you want them to stay in one piece.

28 MPH (or slower) is the limit in all 50 states, BUT the loophole in SOME states is to electronically or mechanically limit the speed.

Unless there's a federal law that's heavily mandates that bike hubs should be color coded to represent the power wattage, it's easier to just have no power wattage limit, require no throttle on any Ebike, and class of ebikes based on speed, with max being 25mph
If someone mods the Ebike to go faster than that, easier to hunt down and arrest them

Exactly! That is why I decided to post and warn the parent. I think most of the parents either don't know or don't care.....causing this problem.
