Nintendo bricks consoles that they detect using a cartridge thats has been copied and pirated/uploaded online. So when you buy preowned, you don't know if it was used for piracy
Last time I did the b2g1 through Gamestop 2 of the 3 games were missing the box and cover art and the 3rd game was wrong. It was an absolute pain in the butt working with GS to get the correct game. Buyer beware if you're a collector and want the case with matching artwork you're probably not going to get it for all 3 games
You best bet is to go in store and see what your local is has honestly.

If you have a Switch 2 (or planning to get one), do not buy any pre-owned switch games so you dont have to deal with Nintendo banning your Switch 2 and then having to Unban it.
If however you also have a Switch 1 and only play Switch 1 games that dont have a Switch 2 update on Switch 1 then you can safely buy any Switch 1 pre-owned game (Pokemon Sword/Shield,etc...) but you still have to avoid any switch game you will put into a Switch 2 (such as Pokémon Scarlet/Violet, Zelda BOTW/TOTK, Donkey Kong Bananza, etc.. )

Each cartridge has a unique key and when they see the same unique key multiple times they ban both switch 2 (and then let the used market buyer prove their purchase to unban) because they don't know which is the real one and which is the clone.

I hold no sympathy for companies that use overbearing DRM.

Switch 2 native games like DK Bananza can't be copied by devices like the MiG Switch so those should be safe.
