This open box Gigabyte RX 9070 XT is a fast 4K gaming card, but the big draw is tempered by concerns about its cooling and warranty coverage. The card has a history of running hot from thermal paste or pad issues, and some fixes only bring small temperature gains. Best Buy's return window gives some short term protection, and the card can be checked quickly with a stress test, but open box warranty handling may depend on the receipt details. It is a strong performer if the unit is healthy and the paperwork is clear.
A repaste or thermal pad/putty refresh may reduce overheating if thermal pads are mismatched or other components run hot.
Some open-box purchases have worked out well without thermal issues or other problems after purchase.
The card can run cool and quiet in an ITX Cooler Master case during 4K gaming workloads.
A quick validation approach can help catch thermal or stability problems within the return window.
Open-box units may be risky because OEM warranty coverage may not apply if thermal issues or artifacting appear later.
A Furmark-style stress test may reveal issues quickly, but it still leaves the possibility of later failures after the initial check.
Heat problems have been reported that may stem from bad thermal paste application, making an open-box unit feel unreliable.
The savings may be too small if warranty coverage is uncertain, especially when other 9070 XT pricing is close to the open-box cost.

You may have already confirmed, but double check if running this alongside the 5700x3D is viable. May be CPU bottlenecked pretty quickly. I know the x3D processors are solid, but I suspect 7800x3D and up would be the target baseline.
On another note. I have this GPU in a ITX cooler master case. It was when walmart had this cleared out for $550 a few months ago. It runs cool and quiet in my use case at 4K gaming. Haven't had issues with it yet but I do undervolt all my systems. Temps aren't as cool as the Powercolor Red Devil Spectral 9070XT I have, that hovers around 40-60 idle to load. The Gigabyte hovers 45-65. Still very nice considering formfactor and price difference.
Right to repair laws in the US have already prevented companies from voiding warranties for removing stickers. This may be a state by state issue but in my state it is covered. Damaging during repair is another story entirely.

It is amazing how easy the corpos are moving the goalposts and consumers just accept it. So much Stockholm Syndrome.
You will likely have deja vu many times over next few years
