I was going to say the same thing and this is especially ubiquitous at Walmart.

Ubisoft in particular also likes to convert older releases over to code-in-box so if you didn't get the physical cartridge version while it was still around then it may be unlikely to find at this point.

The cover art says assassins creed 3 is gamecard and the other 2 is digital downloads.

First of all there is no Assassin's Creed 3 in this collection. Secondly, the cover art in the listing is misleading and means nothing when you look at the reviews and within seconds you can see people's photos showing the real cover art where it has a notice that says "Full Game Download" and "Game Card Not Included". Also, the cover art displayed in the listing is for a European version (hence the PEGI rating), which further emphasizes the fact that it is misleading.
