A New York man was stunned to find out that his four-year-old twins were not an accidental pregnancy after all -- but that his desperate girlfriend secretly stashed away his sperm and used it for an in-vitro procedure, he charges in a lawsuit.
Joseph Pressil, 36, was not planning on having children with Anetria Burnett, with whom he was in a relationship for six months in 2007, he said.
So she took matters into her own hands, he told the New York Post, in order to remain in his Texas house and make a legal bid for half of his possessions.

Maybe she bought the condoms? Maybe she told him she'd "handle" everything? Maybe she fished them out of the garbage can? Who knows? Not you or me for sure.
MY point is that this happens too often for it to be dismissed and that the men involved typically wind up getting screwed (pun intended) by the legal system and find themselves responsible for kids they never intended to conceive. Did you read the part where the woman did this so she could stay in his house and try to get half his money? Was that part reasonable?
I don't think guys keep tabs on every single condom they use, let alone know if something has been taken from them.
And not every condom has spermicide in it. In fact, it has been said that spermicide can weaken a condom and make it prone to breakage.
Many women are allergic to the spermicide in some condoms which is why they make them without spermicide. All she had to do is say she was allergic.
Also, sperm can live inside of a woman's body for days before it dies. It's not that big a stretch to think that if that's possible, it is also possible that she went and grabbed the condoms out of the trash after he left or fell asleep (Nagin) and froze them or something.
I agree with VQ on this one: the system is set up with a bias against the sperm donor whether he meant to or not. If some woman is going to let herself get knocked up and put her health in danger, how can she be expected to be any better than the father of the child. The playing field is perfectly level if you ask me.
In this case, she took steps that can legally point to her intention to get pregnant. She used deception and is trying to extort money from this guy. Since she deceived him and tried to get money from him, that's grounds for legal charges. The man on the other hand (idiot that he is) took steps to prevent her from getting pregnant. Who's the more responsible and law abiding citizen here?

Reverse the situation. Man is crazy, wants a child with this woman, pokes holes in his condoms or messes with her birth control pills. She gets pregnant, wants an abortion. He takes her to court to prevent it, forces her to have the kid. Yet, she willingly had sex with him! Maybe they even talked about having kids one day in an abstract & non-specific way. Hmm.
If I start questioning her story - saying it sounds "fishy" and "implausible" - bet you good money people come down on me like a ton of bricks, "you asshole how dare you try to blame her!" Why is it different when the victim's a man?
So the answer to this problem is an invasive, non-reversable (yes I am aware it can be reversed in certain circumstances, not relevant here - it's another surgery he has to undergo) surgical procedure? Not, oh, say, holding the perpetrator of this crime responsible for her insane actions by any chance?
The very unfortunate part of all of this is that these children are caught in the middle. What's even worse is that I bet despite all of this, the mother winds up with custody & the father ends up paying child support. Which was her goal from the beginning...
