SUBMISSION REQUIREMENTS: All Submissions must meet the following requirements to be egible:
For the Photo- Must be in the format of .jpg, .gif or .png.
For the Caption- Must be English between 25 and 100 words.
Each Submission must also comply with the following additional Submission Guidelines:
The Submission may not contain any content that is lewd, obscene, sexually expcit, pornographic, disparaging, defamatory, belous, obscene, or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole and unfettered discretion.
The Submission must be the Entrant's original work, created solely by the Entrant, and must not infringe the copyright, trademark, privacy, pubcity, or other intellectual rights of any person or entity.
If any person appears in the Submission other than the Entrant, the Entrant is responsible for obtaining, prior to sending the Entry, any and all releases and consents necessary to permit the exhibition and use of the Submission by Sponsor as set forth in these Official Rules. If any person appearing in any Submission is under the age of majority in their state, country or province of residence, the signature of a parent or legal guardian is required on each release.
The Submission must not contain any personally identifiable information of any person other than the Entrant. USE OF SUBMISSION:
Uploading a Submission constitutes entrant's consent to give Sponsor and its censees, successors and assigns and any designated person or entity acting on its behalf a royalty-free, irrevocable, perpetual, non-exclusive cense to use, reproduce, modify, pubsh, exploit, modify, edit, transmit, distribute, create derivative works from, and display such Submission (including without mitation, the names and kenesses of any persons or locations embodied therein) in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for Sponsor's promotional or marketing purposes in perpetuity without compensation, permission or notification to Entrant or any third party. If requested, the Entrant will sign any additional documentation for the Sponsor , its censees, successors, assigns or its designees to make use of the non-exclusive rights the entrant is granting to use the Submission.
JUDGING:
All egible Submissions received by Sponsor will be judged by a panel of quafied judges based on the following equally weighed criteria: Creativity of Photo (1-5 points); Creativity of Caption (1-5 points); and Appropriateness to Theme (1-5 points). The five (5) Entries with the highest scores will be deemed the Grand Prize winners. In the event of a tie, the person among the tied entrants with the highest score in Creativity of Photo will be declared the winner. If a tie still exists, the person among the remaining tied entrants with the highest score in Creativity of Caption will be declared the winner. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of egible and quafied Submissions.
Each potential winner will be required to sign an Affidavit of Egibity, a abity/Pubcity Release (where lawful) within five (5) business days of notification. If the potential winner does not complete the required forms as instructed and/or return the required forms within such time period , the Sponsor may disquafy the potential winner and, at the Sponsor's option, select an alternate winner.
PRIZES: Five (5) grand prize winners will each receive: Seven (7) Be My Guest Certificates, each vad for one (1) night hotel accommodations in a standard suite at any Embassy Suites Hotel worldwide of winner's choice (maximum capacity of six people per room) and check(s) totang in the amount of $10,000.00 U.S. dollars made payable to the grand prize winner, which includes $5,000.00 which may be used towards a round trip economy class airne tickets for four (4) people and $5,000.00 which may be used for vacation spending money. Winner is responsible for paying the appcable income taxes on receipt of prize. Any difference between actual costs incurred by winner on airne transportation and $5,000 will not be awarded to the winner. Furthermore, any difference between actual costs incurred by winner on spending money during vacation and $5,000 will not be awarded to the winner. Certificates are subject to terms and conditions specified thereon. Certificates expire one (1) year from date of issue. Each Winner, by acceptance of Prize, grants to the Sponsor, its censees, successors and assigns and each of their respective designees the right to pubcize such Winner's name, address (city, state, and country of residence), photograph, voice, statements and/or other keness and prize information in any media now known or hereafter devised for advertising and promotional purposes, throughout the world, in perpetuity, without mitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: In the event of a dispute as to any Submission, the authorized account holder of the email address used to register will be deemed to be the entrant and must comply with these Official Rules and Restrictions. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, onne service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each entrant may be required to show proof of being an authorized account holder. By participating in the Promotion and submitting an Entry, each Entrant agrees to all terms and conditions and further agrees that the Released Parties are not responsible for late, incomplete, inaccurate, misdirected, lost, damaged, delayed, ; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availabity or accessibity or miscommunications or failed computer, satelte, telephone or cable transmissions, nes, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Promotion, including, without mitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize or in any Promotion-related materials, or the cancellation or postponement of any travel fght or lodging. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the Website. Persons who tamper with or abuse any aspect of the Promotion or website or attempt to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor's representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disquafied and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion should any portion of the Promotion be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, and, if terminated, Sponsor will select the top five (5) Submissions in accordance with the above stated judging criteria from all egible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Any attempt to deberately damage the content or operation of this Promotion is unlawful and subject to legal action by the Sponsor or their respective agents. Sponsor shall have the sole right to disquafy any entrant for violation of these Official Rules or any appcable laws relating to the Promotion, and to resolve all disputes in their sole discretion. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
GOVERNING LAW AND VENUE: All issues and questions concerning the construction, vadity, interpretation and enforceabity of these Official Rules or the rights and obgations of participants or Sponsor in connection with the Contest shall be governed by and construed in accordance with the internal laws of the state of New York, without giving effect to any choice of law or confct of law rules or provisions that would cause the appcation of any other state laws. Claims may not be resolved through any form of class action. Venue for all suits will be in the Eastern District of Virginia or, if there's no federal jurisdiction, Fairfax County, Virginia.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DEBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUAFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Entries generated by a script, macro or other mechanical or automated means will be disquafied.
