OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE IN OR WIN THE 2013 TYSON® GRILLED & READY Products '30 DAYS 30 WAYS 30 REWARDS' SPOKESPERSON CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
This contest is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering, you understand that you are providing your information to the Sponsor and not to Facebook.
Entry constitutes your acceptance of these Official Rules.
1. DESCRIPTION: Tyson Foods, Inc. ("Tyson Foods or Sponsor") provides this Contest to you to give you the opportunity to enter for a chance to be one of three (3) Tyson Foods spokesperson winners.
A.Each winner will represent Tyson Foods as one of the following consumer 'personas" ("Category") for the 2013 Tyson® Grilled & Ready Products '30 Days 30 Ways 30 Rewards' program: i. Time-Crunched: "I know how to eat right and how important it is to work out. I just never have enough time! I need a way to simplify meals while keeping them nutritious, delicious and low-calorie – and work some fitness into my busy life."ii. Will-Power Challenged: "I start out strong, but my follow-through fades and I slide back into my old habits. I need someone to help me and to stick with me long enough so I don't get discouraged while I develop new habits." iii. Food Lover: "I know the importance of eating right and exercising, but I love to eat and to cook. I don't want my food to be boring! I need convenience and good quality ingredients so I can whip up meals that I can enjoy."
B.Each winner will be featured on and contribute content to the Grilled and Ready Facebook page and the '30 Days 30 Ways 30 Rewards" Facebook promotional tab.
C.Each winner shall receive fitness / healthy lifestyle equipment or services valued at $5,000 and based on each winner's specific needs.
2. PARTICIPATION DATES & CONTEST STRUCTURE: Contest submission begins September 12, 2012 at 12:00:01 PM ET and ends October 15, 2012 at 11:59:59 AM ET ("Submission Period"). Three (3) winners (one for each Category) will be selected at the end of the Contest from among all eligible Submissions received during the Submission Period.
3. WHO MAY SUBMIT ENTRIES: Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or the age of majority in their jurisdiction of residence hereinafter referred to as "Participants." Participants cannot have been charged or convicted of a felony or misdemeanor, or currently be delinquent on a government ordered payment, such as child support, spousal support, alimony, or tax payments. Employees and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside or those living in the same households, whether or not related) of Tyson Foods, and its parents, affiliates, subsidiaries, prize supplier(s), distributors and advertising and promotion agencies (collectively, "Promotional Parties") are not eligible to enter or win. Void where prohibited, taxed, or restricted by law. Contest is subject to all applicable federal, state and local laws.
4. HOW TO SUBMIT ENTRIES: During the Submission Period, visit the '30 Days 30 Ways 30 Rewards' promotional tab on the Grilled and Ready Facebook page at https://www.facebook.co
A.Photo requirements: All photos must be in JPEG, PNG or Gif format and no larger than 3 MB. Photo must be relatively recent and Participants must currently appear similar to the way they look in their photos.
B.Essay requirements: Essay should be up to 350 words, and should include and/or discuss: ◦Why Participant would like to represent the Tyson® Grilled & Ready brand for the purposes of this promotion
◦How Participant hopes to benefit from participation
◦How Participant can help motivate others to lead a healthy lifestyle incorporating Tyson® Grilled & Ready products
All Submissions must be made before the end of the Submission Period. Once a Submission is made, Participant will not be permitted to change Submission. Limit one (1) Submission per person. All Submissions are subject to approval by the Sponsor. Any attempt to make more than the stated number of Submissions by using multiple usernames/email accounts or by any other method may void all Submissions from that Participant. Incomplete Submissions, including but not limited to those Submissions that do not address the requirements set forth in these Official Rules, will not be eligible. Proof of sending does not constitute proof of actual receipt by Sponsor. Submissions generated by script, macro or other automated or improper means and Submissions made by any means which subvert the participation process will be void.
5. SUBMISSION REQUIREMENTS: Submissions must include the following elements to be eligible:
•Selection of one of the 3 'personas' as detailed on the 30 Days 30 Ways 30 Rewards' Facebook promotional tab.
•Completion of registration form and qualifying questions including personal bio: name, age, lifestyle, interests, social media activity.
•If you enter and win, you agree to the following winners' terms and conditions:◦You will agree not to discuss or disclose details of the Tyson® Grilled & Ready Products '30 Days 30 Ways 30 Rewards' program prior to the official announcement / introduction of each Persona on the Grilled and Ready Facebook page, on or about November 19, 2012.
◦You will be available to travel to New York area for a photo shoot during the week of November 5, 2012, at Tyson Foods expense.
◦You agree to inclusion of your submitted photo and personal bio / lifestyle information on the Grilled and Ready Facebook page and '30 Days 30 Ways 30 Rewards' promotional tab.
◦You agree that we may include your submitted photo and personal bio / lifestyle information in a minimum of seven (7) email blasts to the Tyson Foods promotional database.
◦Use of likeness in '30 Days 30 Ways 30 Rewards' promotional materials including but not limited to Facebook, eblasts, digital media, in-store media, mobile media and print ads.
◦Between November 19, 2012 and December 31, 2012: You will provide comments once weekly relating to your enthusiasm and excitement at being selected as one of the '30 Days 30 Ways 30 Rewards' Facebook Faces for posting to the Grilled and Ready Facebook page.
◦Between November 19, 2012 and January 31, 2013: Your Facebook profile picture will be a recent photo of yourself only.
◦Between January 1, 2013 and January 31, 2013: You will provide once weekly comments specific to recipes and tips provided as part of the '30 Days 30 Ways 30 Rewards' program for chosen persona for posting on Grilled and Ready Facebook page.
You will provide once weekly progress updates relating to personal experiences specific to your chosen persona for posting on the Grilled and Ready Facebook page.
You will engage in weekly conversations with Grilled and Ready Facebook Fans in response to your posts and comments.
◦Between February 1, 2013 and September 30, 2013: You will provide three (3) additional progress updates to be included in email blasts to the Tyson Foods promotional database or on the Grilled and Ready Facebook page.
◦You will abide by Tyson Foods social media policy including: Disclosure of status as a Tyson® Grilled & Ready Products '30 Days 30 Ways 30 Rewards' contest winner and spokesperson on personal social media. This includes following provided guidelines for the content of your first post.
No mention may be made of other manufacturers' brands, competitive or otherwise.
Following provided guidelines for responding to comments or posts on your personal social media that reference Tyson® Products or the Tyson® Grilled & Ready '30 Days 30 Ways 30 Rewards' program in an unfavorable way.
Submission may not contain, as determined by the Sponsor, in its sole discretion, any content that: •Appears to be a duplicate of a previous Submission
•Is inappropriate, offensive, or obscene.
•Communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate.
•Violates any law.
By making a Submission, Participant warrants and represents that s/he consents to the Submission and use of the Submission in the Contest and to its use as otherwise set forth herein. Participant further agrees and grants to Sponsor the right to use the Submission, and the rights granted herein including copyright interests and the right of publicity, to use Participant's entry, bio, photo, voice, picture, image, video, and all other elements for the purposes of advertising Sponsor's products and services, and by way of clarification and not limitation, in perpetuity for historical reference purposes. By making a Submission, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your first name and last initial, likeness, picture, address (city and state only), and written statements. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all Participants in the Contest, including non-Winners and Winners. Promotional Parties are not responsible for any unauthorized third party use of any Submission. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants.
Sponsor reserves the right to disqualify any Submission for any reason, in its sole and absolute discretion, including its determination in its sole discretion that a Submission fails to satisfy any of the above requirements.
6. INTELLECTUAL PROPERTY: All Submissions and all information contained therein, including the copyright and all other intellectual property rights of Participant, become the property of Sponsor and will not be acknowledged or returned. By submitting a Submission, you irrevocably assign to Sponsor all right, title, and interest in your Submission in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade. The rights granted under this paragraph shall extend to all Submissions and all other submitted materials related to the Contest, including those submitted by non-Winners and Winners.
Sponsor reserves the right to waive any or all Contest entry requirements set forth herein. Sponsor reserves the right during or upon completion of the Submission Period, to request that any Participant resubmit his or her Submission, which fails to comply with the Contest Submission Requirements. By submitting a Submission, you agree that your Submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Submission on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.

7. WINNERS DETERMINATION: Winners will be evaluated by a team of personnel from Tyson Foods marketing agency and will be selected based on the following criteria: •Alignment of personal challenges with chosen 'persona'. One (1) winner will be selected to represent each of the three personas.
•Representative of the diversity inherent within in the Tyson® Grilled & Ready Products target based on: ◦Age
◦Race
◦Lifestyle (working/non-working, children/no children)
•Conveys a positive outlook and an engaging and pleasant personality that will be motivating to others
•Extent of social media activity and size of following
8. POTENTIAL WINNER NOTIFICATION: Potential Winners will be notified via phone, mail or email on or about October 22, 2012. Prior to being confirmed as a Potential Winner, Participants whose Submissions are selected will be required to provide proof of identity, verification of eligibility and compliance with these Official Rules, and, unless prohibited by law, complete written and notarized Affidavits and Publicity Releases ("Affidavits") as well as any other documents required by Sponsor, all of which must be received fully-executed within six days of receipt or such Potential Winner may be disqualified and an alternate Potential Winner may be selected. Sponsor will provide Potential Winners with a pre-addressed, overnight envelope in which to mail the Winners Affidavits back to Sponsor. Participants agree that, if they are selected as Potential Winners, Sponsor may conduct a background check, and Participants agree to execute all documents necessary for Sponsor to obtain such background check. In the event it is determined that: (a) any Participant has not complied with these Official Rules, (b) Sponsor is unable to contact a Potential Winner within a reasonable time period, (c) Potential Winner has failed to execute and return any required documents within the specified time period or has made false statements in connection with his/her participation in the Contest, or (d) a Winner notification is returned as undeliverable or Sponsor determines, in its sole discretion, that the Potential Winner's background check results are inconsistent with the Sponsor's image, then such Potential Winner and his/her Submission may be disqualified. If Potential Winner is disqualified for any reason, at Sponsor's discretion, a new Potential Winner may be selected. All new Potential Winners shall be subject to the same requirements as the original Potential Winners.
9. GENERAL CONDITIONS: Information submitted will be used by Sponsor as described in its Privacy Policy and Winners' information may be made available as part of a public Winners' list. Promotional Parties and their respective officers, directors, agents, representatives and employees (collectively, "Released Parties") are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete, delayed or undelivered Submissions; all of which will be void. Released Parties are also not responsible for problems submitting entries or materials from the website or of any other technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit the ability to submit entries. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds or suspects to be tampering with the Submission or any website, including any act that is intended to or has the effect of annoying, abusing, threatening, harassing, or disparaging any other individual, Sponsor or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by an individual to deliberately damage any website is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such individual(s) to the fullest extent permitted by law.
10. DISPUTES: This Contest is governed by the laws of the United States and the State of Arkansas, without respect to conflict of law doctrines. As a condition of participating in this Contest, Participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Arkansas having jurisdiction. Further, in any such dispute, under no circumstances will Participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than Participant's actual out-of-pocket expenses (e.g. costs associated with entering), and Participant further waives all rights to have damages multiplied or increased.
11. WINNER INFORMATION: Winners' names and Winners' Submissions will be identified on the Grilled & Ready Facebook page on or around November 19, 2012.

8. POTENTIAL WINNER NOTIFICATION: Potential Winners will be notified via phone, mail or email on or about October 22, 2012. Prior to being confirmed as a Potential Winner, Participants whose Submissions are selected will be required to provide proof of identity, verification of eligibility and compliance with these Official Rules, and, unless prohibited by law, complete written and notarized Affidavits and Publicity Releases ("Affidavits") as well as any other documents required by Sponsor, all of which must be received fully-executed within six days of receipt or such Potential Winner may be disqualified and an alternate Potential Winner may be selected. Sponsor will provide Potential Winners with a pre-addressed, overnight envelope in which to mail the Winners Affidavits back to Sponsor. Participants agree that, if they are selected as Potential Winners, Sponsor may conduct a background check, and Participants agree to execute all documents necessary for Sponsor to obtain such background check. In the event it is determined that: (a) any Participant has not complied with these Official Rules, (b) Sponsor is unable to contact a Potential Winner within a reasonable time period, (c) Potential Winner has failed to execute and return any required documents within the specified time period or has made false statements in connection with his/her participation in the Contest, or (d) a Winner notification is returned as undeliverable or Sponsor determines, in its sole discretion, that the Potential Winner's background check results are inconsistent with the Sponsor's image, then such Potential Winner and his/her Submission may be disqualified. If Potential Winner is disqualified for any reason, at Sponsor's discretion, a new Potential Winner may be selected. All new Potential Winners shall be subject to the same requirements as the original Potential Winners.
9. GENERAL CONDITIONS: Information submitted will be used by Sponsor as described in its Privacy Policy and Winners' information may be made available as part of a public Winners' list. Promotional Parties and their respective officers, directors, agents, representatives and employees (collectively, "Released Parties") are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete, delayed or undelivered Submissions; all of which will be void. Released Parties are also not responsible for problems submitting entries or materials from the website or of any other technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit the ability to submit entries. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds or suspects to be tampering with the Submission or any website, including any act that is intended to or has the effect of annoying, abusing, threatening, harassing, or disparaging any other individual, Sponsor or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by an individual to deliberately damage any website is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such individual(s) to the fullest extent permitted by law.
10. DISPUTES: This Contest is governed by the laws of the United States and the State of Arkansas, without respect to conflict of law doctrines. As a condition of participating in this Contest, Participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Arkansas having jurisdiction. Further, in any such dispute, under no circumstances will Participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than Participant's actual out-of-pocket expenses (e.g. costs associated with entering), and Participant further waives all rights to have damages multiplied or increased.
11. WINNER INFORMATION: Winners' names and Winners' Submissions will be identified on the Grilled & Ready Facebook page on or around November 19, 2012.
