If you ever want to be taken seriously about that kind of thing, you need to drop the "smoking anywhere is a right of a free person." Second hand smoke causes cancer. If it's a privately owned restaurant run by all family members who smoke, then MAYBE you have a case to set it up as a safe haven for smokers. But if it's a privately owned restaurant that hires people to work there, then no case.

If we lived in a society where all substances were legal and people were counted on to use self control and responsibility to govern their actions with those substances in public then there'd be reason to argue that smoking bans were taking freedoms away. But we don't.
