Second, one of the ways the law got passed initially was based on the fact that there's no way for an employee to opt out of second hand smoke at an establishment and therefor the choice was taken out of their hands, so it's a valid argument.
And third, if you were to bring back smoking at establishments that, say, just opened and they needed to hire people, but it was going to be a smokey environment, then there would most likely be stipulations on who could work there - namely people who don't smoke would be an insurance liability. However, just like you can't ask someone about their personal medical history, you shouldn't be able to ask someone their personal smoking habits.
And as an aside, it would have been an easier argument for me to make that a smoke-full environment is a hostile work environment, and that IS against the law.
My Gram is so mean and thoughtless to me- no matter what I try to do or how I approach her, I just end up feeling sick and exhausted and angry when I have any contact with her.
I dont like having these negative feelings and I struggle with them. She's old, she wont be here forever, try to be nice to her. And whenever I do, I feel like she gives me a big punch and I regret even considering talking to her again.

Negative. That's a different scenario than what we are talking about because you are affecting someone else's property against their will. Apples and oranges, my quadruped friend. You should have the right to do what you want on your property. Once it affects my property, then we should look at arbitration or local laws.
