DATES OF PROMOTION: "The K & N 2013 Horsepower Challenge" Sweepstakes (the "Sweepstakes") begins at 5:00 p.m. Eastern Time ("ET") on October 26, 2012 and ends at 6:00 p.m. ET on March 8, 2013 (the "Sweepstakes Period").
Limit one (1) entry per person/email address throughout the entire Sweepstakes Period.
ELIGIBILITY: In order to be eligible for entry into the Sweepstakes, you must be a legal citizen or permanent legal resident of the 50 United States or the District of Columbia, excluding residents of New York and Florida, who are 18 years of age or older or the age of majority in which they reside, can comprehend and speak the English language (both verbal and written), and have a valid Social Security number and valid driver's license at the time of entry.
Finalists are required to travel on April 4th, 2013 and complete travel on April 7th, 2013 and must be able to attend all required race and publicity events or prize will be forfeited (as discussed in Finalist section).
DRAWINGS:
FINALIST DRAWING: On or about March 12, 2013 eight (8) Finalist Prize winners (the "Finalist") and one (1) Alternate Finalist Prize winner the "Alternate Finalist") will be selected in a random drawing conducted under the supervision of Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these official rules, and are final and binding in all respects. Odds of being selected as a Finalist or Alternate Finalist and winning a Finalist Prize are dependent upon the total number of eligible entries received.
GRAND PRIZE SELECTION PROCESS: On April 5th, 2013, Finalists and Alternate Finalist will attend a publicity event prior to the K&N Horsepower Challenge Race (the "Race") scheduled for April 6, 2013 (the "Event"). If a Finalist fails to arrive at the Event, he/she is subject to disqualification at the sole discretion of Sponsor and the Alternate Finalist will be deemed a Finalist and chosen to participate in the Event, time permitting. At the Event, each Finalist will randomly draw their professional Pro Stock driver in the order in which a third party Representative pulls the Finalist's name. Each Finalist will then randomly draw one (1) of the eight (8) professional Pro Stock drivers participating in the Race and will be assigned that professional Pro Stock driver. On April 6, 2013, the Grand Prize winner will be determined based upon the Finalist who is paired with the professional Pro Stock driver that finishes first in the Race according to the official race results as certified by the NHRA. Odds of winning the Grand Prize are approximately 1:8 but depend on the actual number of Finalists that are confirmed and attend the Event, which driver a Finalist is randomly paired with, and that driver's performance in the Race/the official Race results. If a Finalist can not be confirmed prior to the Event or does not attend the Event for any reason, then only the total number of Finalists who were verified and are actually in attendance at the Event will be paired with a professional driver. In the Event that the winning professional driver is not paired with a Finalist, the Grand Prize winner will be determined based upon the finalist paired with the professional driver who finishes the race in the next best time (according to the official race results as certified by the NHRA).
PLEASE NOTE FOR ALTERNATE FINALIST: An Alternate Finalist will only be afforded the opportunity to participate in the Event for a chance to win the Grand Prize should a Finalist; (a) forfeit their right to participate in the Event, (b) not meet the requirements to participate in the Event; or (c) be disqualified from participating in the Event prior to the start of the Event, all of which will be determined by the Sponsor at their sole discretion and in accordance with these official rules. Any Alternate Finalist's presence at the Event does not guarantee participation in the Event or the chance to win the Grand Prize.
In the event the Race is cancelled, the Grand Prize winner will be selected in a random drawing from among the actual number of confirmed Finalists and will be conducted under the supervision of the Representative present at the Selection Process or the National Sweepstakes Company, whose decisions are based on their sole discretion and interpretation of these official rules, and are final and binding in all respects.
PRIZES
FINALIST & ALTERNATE FINALIST PRIZES: Eight (8) Finalist Prizes and one (1) Alternate Finalist Prize of a trip for Finalist Prize winner & guest or Alternate Finalist Prize winner & guest to the "14th Annual SummitRacing.com NHRA Nationals " in Las Vegas, NV from April 4, 2013 through April 7, 2013 (the "Prize Trip Package") will be awarded. Prize Trip Package includes: i) $1000 travel voucher, ii) a maximum of four (4) days and three (3) nights standard accommodations at a hotel determined by Sponsor in its sole discretion, and iii) two (2) Full event credential to the NHRA Nationals race and all scheduled race events. The $1000 travel voucher is inclusive of the following: a) roundtrip coach-class air travel for Finalist Prize winner & guest (ARV: $800), b) ground transportation to/from hotel/airport/event (ARV: $200). FINALISTS AND ALTERNATE FINALIST ARE RESPONSIBLE FOR BOOKING THEIR FLIGHTS AND ALL TRANSPORTATION for them and their guest. Finalists, Alternate Finalist and guests must start travel on April 4th, 2013 and complete travel on April 7, 2013 (or on such other dates determined by Sponsor in its sole discretion so as to attend the Race). Finalists and Alternate Finalist must attend all scheduled race events or prize will be forfeited in its entirety. Guests may attend the scheduled race events, but will not participate in the Event. If Finalists and Alternate Finalist are not able to travel on these dates and attend the events then the Finalist and Alternate Finalist will have to forfeit the Finalist and Alternate Finalist Prize. Travel must be roundtrip. Sponsor is not responsible for airline cancellations or delays. All expenses and incidental travel costs not expressly stated in the Prize Trip Package description above, including but not limited to, ground transportation, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, meals, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of Finalist and Alternate Finalist. Any taxes imposed on the income of the Finalist and Alternate Finalist as a result of winning the Finalist and Alternate Finalist Prize and all other expenses not specifically mentioned herein as part of the Finalist and Alternate Finalist Prize are solely the responsibility of the Finalist and Alternate Finalist. All travelers must possess required travel documents (e.g. valid government-issued photo I.D.) prior to departure. Travel restrictions, conditions and limitations may apply. No transfer or substitution of prize is allowed except at the sole discretion of the Sponsor due to prize unavailability for any reason and only then for prize comparable value. There is no cash alternative offered, except at the sole discretion of the Sponsor. The Finalists and Alternate Finalist is required to comply with any and all applicable federal, state and local laws, rules and regulations. The value of the prize is taxable as income and Finalists and Alternate Finalist is solely responsible for all matters relating to the prize, including, but not limited to all applicable federal, state and local taxes that become due with respect to the prize. Actual retail value will vary depending on the departure airport of Finalist or Alternate Finalist. Any difference between the stated Approximate Retail Value ("ARV") of the Prize Trip Package and the actual value will not be awarded. The ARV of the Prize Trip Package is $1,750.
GRAND PRIZE: One (1) Grand Prize of a 2013 Toyota Tacoma with TRD parts & accessories, having a Manufacturer's Suggested Retail Price (the "MSRP") of $38,400.75 (the "Grand Prize Vehicle"). Grand Prize Vehicle color, options and accessories to be determined at the sole discretion of the Sponsor or Toyota. Grand Prize winner must have and provide a valid U.S. Driver's License and proof of acceptable Insurance Coverage before being awarded the Grand Prize. The Grand Prize winner is required to comply with any and all applicable federal, state and local laws, rules and regulations including, but not limited to licensing and insurance requirements. Grand Prize winner will be solely responsible for any applicable registration, license, title and insurance fees, all taxes (federal, state, local and/or income) and any expenses not listed herein related to the acceptance and use of the Grand Prize. The Sponsor will make arrangements to deliver the Prize Vehicle to the winner in a reasonable amount of time after the Event. The total value of the Grand Prize is taxable as income (Grand Prize winner will be taxed on the combined value of the Grand Prize AND the Finalist Prize). The depiction of the Prize Vehicle in any advertising or promotional materials or physical display may not reflect the actual vehicle delivered to the winner.
