Harbor Freight Class Action Settlement - Get cash back or gift cards for purchases made from 4/8/11-12/15/16!!

Harbor Freight just settled a class action suit due to falsely advertising the "regular price" of items, and therefore falsely claiming the amount that you save when an item is "on sale". Full details of the case and settlement, as well as instructions on submitting a claim, can be found here: http://www.nationalsalepricesettlement.com.

The options to claim damages are as follows:

OPTION A. Customers who have itemized Harbor Freight receipts reflecting one or more purchases between April 8, 2011 and December 15, 2016 with a "you saved" amount reflected on their receipts can submit copies of those receipts and elect to receive either 20% in cash, or 30% in a Harbor Freight gift card, of the total "you saved" amount listed on their receipts, excluding any amounts reflecting free items or items that were later returned.
EXAMPLE: If you have receipts showing total "savings" on multiple items totaling $480, you have the option of getting 20% cash back ($96) or 30% ($144) on a Harbor Freight gift card.

OPTION B. Customers who have credit or debit card statements reflecting one or more purchases at Harbor Freight between April 8, 2011 and December 15, 2016 can submit copies of those statements and elect to receive either 10% in cash, or 12% in a Harbor Freight gift card, of the total Harbor Freight purchases on their credit or debit card statement(s), excluding any amounts reflecting items that were later returned.
EXAMPLE: If you have credit card statements showing $2,400 in purchases at Harbor Freight, you have the option of getting 10% ($240) cash back or 12% ($288) on a Harbor Fright gift card.

OPTION C. All other customers who made purchases at Harbor Freight between April 8, 2011 and December 15, 2016 may submit one declaration, signed under penalty of perjury, stating that they purchased an item from Harbor Freight (other than a free or later-returned item) that was advertised with a higher reference price (e.g., "reg. $XXX," "only $XXX," or "comp. at $XXX") adjacent to a lower current offering price, and that they do not have itemized Harbor Freight receipts or credit or debit card statements of their Harbor Freight purchases. Customers submitting this declaration will receive one $10 Harbor Freight gift card.

11/5 Update:

Gift cards are currently being mailed out for remaining Class A & B claimants who opted for compensation in the form of HF gift cards. Several have already confirmed receipt of gift cards by USPS or FedEx. The settlement administrator anticipates that all gift cards should be mailed out by end of month.

if HFT has your email on file and you identify yourself (phone number usually) during a purchase, the email you receipts. if you've done that, might be worth searching through your email for those receipts.

I have already found about $4,000 worth of stuff that I bought. I was adding a bunch of stuff to my workshop during that time and bought saws, sanders, tool boxes, workbenches, all sorts of tools. I'm going to make out pretty good! I wonder if there is a max limit per customer? I didn't see one, but then again didn't read all the fine print yet.

However, I did see this: "If, after payments for all valid claims have been calculated, the total amount paid to Class members, plus administrative fees (up to a maximum of $3 million), plus attorney's fees, is less than $23 million, Class members with valid claims may be eligible for additional compensation on a pro rata basis."

So basically if the total of all claims are LESS than $23M each claimant will actually get MORE than what is promised in the settlement! Doesn't say anything about if it goes over $23M, so there might not be any cap. This is one hell of a generous settlement if you ask me! You usually need to send in a bunch of paperwork and jump through a bunch of hoops for like $20.

They must have stopped the "you saved...." on my emailed receipts sometime in late 2015; I don't see the 'you saved' amount printed on any of my 2016 receipts sent to my email inbox.

Whether option A or B is better is going to be entirely on a case by case basis. It depends whether or not you have your original receipts, and how much it says you saved on each of those receipts. Let's say you have receipts totaling $2,000 with savings of $1,000....well, 20%/30% of $1K is $200/$300, while 10%/12% of $2,000 is $200/$24. In that case, both options are the same for cash while option A would be better for gift cards.

You can still use those to get 10/12% back. I wonder if you can submit some "you saved" receipts for 20/30% and some that don't say it for 10/12%, or if they all need to be submitted as one or the other.

i remember buying something, but don't have a receipt or credit card statement so I'm going the option C route. It seems option C is mail in only, so after mailing it in are we guaranteed to get a $10 gc in the future? I ask because what if they do not win the case, we get nothing right?

There is no case, they settled through litigation and they have already agreed to the settlement according to the terms outlined on that website. Very few class action suits ever go to trial, 99% of them either get settled or dismissed before ever getting to that point. Usually only the really massive class action suits with damages in the hundreds of millions (or billions) ever go to trial.
