Send a text message containing the word "KINECT" to 97979 and follow the instructions contained in the reply text message. TWO (2) TEXT MESSAGE TRANSMISSIONS ARE REQUIRED TO COMPLETE EACH TEXT MESSAGE ENTRY. Message and data rates may apply. By entering, you agree that you are solely responsible for all message and data charges that you incur. All such charges are billed by and payable to your mobile service provider. (III) Mail-In Entries: On a piece of paper no larger than 4"x 6", print your name, complete address, telephone number (with area code), email address and date of birth and send your mail-in entry to: M&M'S® Brand 90 days Sweepstakes Entries, Department E, P. O. Box 5654, Blair, NE 68009-5654. MAIL-IN ENTRIES MUST BE POSTMARKED BY JULY 29, 2011 AND RECEIVED BY August 5, 2011. No mechanically reproduced, illegible, incomplete, forged or altered mail-in entries will be accepted. Enter by mail as often as you wish, but each mail-in entry must be mailed in a separate outer envelope.
All entries become the exclusive property of Sponsor and will not be returned.
2.SELECTION OF WINNERS: Winners (subject to verification) will be determined from among all eligible entries received in a random drawing to be conducted on or about August 12, 2011 by D.L. Blair, Inc. ("Judge"), whose decisions are final on all matters relating to this Sweepstakes. Winners will be notified by telephone (in the case of text message entries, using the mobile device number used to submit the winning entry (no messages will be left)), overnight mail and/or email.
3.PRIZES AND ODDS: 91 Grand Prizes: each, an XBOX 360® 4GB Console with Kinect™ Sensor and Kinect™ Adventures Game and Kinect™ Sports Game. Approximate Retail Value ("ARV"): $350 each. Total ARV of all Grand Prizes: $31,850. Odds of winning a prize depend on the number of eligible entries received. All expenses associated with a prize are the responsibility solely of its winner. Sponsor reserves the right, at its sole discretion, to substitute any prize with one of equal or greater value. No other substitution or transfer of a prize is permitted. Sponsor is responsible only for delivery of prizes; not responsible for prizes' utility, quality or otherwise. Taxes and fees, if any, are the responsibility solely of winners.
4.ELIGIBILITY: This Sweepstakes is open to individual legal residents of the 50 United States and District of Columbia, age 18 years or older as of May 1, 2011, except employees (and their immediate families and members of the same household) of the Sponsor, Judge, Telescope, Inc. and their respective affiliates, agents and advertising and promotion agencies (collectively, the "Sweepstakes Entities").
5.VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Each winner will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. A prize may be awarded to an alternate winner if affidavit/release is not returned within seven (7) days after mailing to selected winner, if three (3) attempts to contact a selected winner live by telephone are unsuccessful (no messages will be left), if a prize or prize notification letter or email is returned as undeliverable or if a selected winner does not respond to an email within seven (7) days after the date of the email. If any prize is won by a minor, it may be awarded in the name of his/her parent/legal guardian in Sponsor's sole discretion. Limit: One (1) prize per household. Each winner agrees to the use of his/her name, address, likeness and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to a minor to be subject to prior approval of his/her parent/legal guardian.
6.GENERAL: This Sweepstakes is void outside the 50 United States and D.C. and where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Sweepstakes is governed by the internal laws of the State of Delaware. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. Sponsor and Judge are not responsible for: late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected entries, mail or communications; errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, mobile telephones, communications devices or transmission lines; or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Sponsor and Judge are not responsible for communications which are undeliverable as a result of any form of active or passive filtering of any kind or any participant's inability to receive telephone calls, text messages or emails for any reason. The use of automated software or computer programs to enter this Sweepstakes is prohibited and any individual who uses, attempts to use or is suspected of using such methods to enter will be disqualified.
