BIC® SOLEIL® "FOLLOW THE SUNSHINE" PROMOTION OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS PROMOTION IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW.
1. HOW TO ENTER: Promotion begins on May 1, 2012 at 12:00:00 A.M. ET and ends on August 8, 2012 at 11:59:59 P.M. ET (the "Promotion Period"). To participate, go to www.feelthesoleil.com (the "Website") during the Promotion Period. To register, you must fill in your name, address (no post office boxes, only street or rural route addresses), city, state, zip code, phone number, email address, date of birth. You will be prompted to create a password in order to complete your registration with the Website. You may also log in to the Promotion on the Promotion homepage if you have already completed the registration process and created a password. All online entries must be received by 11:59:59 P.M. ET August 8, 2012. No mass entries or mechanically reproduced entries will be accepted.
2. ENTRIES: Daily Prizes: During the Promotion Period, there will be one (1) Daily Prize awarded per day from May 1, 2012 - August 8, 2012 with the exception of every Monday called "Multiple Mondays" during which there will be ten (10) Daily Prize winners. Every Daily Prize Period will last twenty-four (24) hours and will begin at 12:00:00 A.M. (ET) and last until 11:59:59 P.M. (ET) every day. Daily Prize will be featured on the homepage of the Promotion (www.feelthesoleil.com). You can also opt in to receive Daily Prize reminder notifications throughout the Promotion Period via Facebook by "Liking" the BIC Soleil Facebook page during the registration process. Daily Prizes will be announced on the Website and on the BIC Soleil Facebook page. Limit one (1) entry per Daily Prize per person, per e-mail address per day for the entire Promotion Period. Entries for the Daily Prizes must be received during the Daily Prize Period in order to be eligible for that daily drawing. Non-winning daily entries for Daily Prizes will not be carried over to subsequent Daily Prize Periods or any other prize periods. Participants must re-enter for the next Daily Prize to be eligible.
Road Trip Surprise Prizes: During the Promotion Period, there will be eight (8) additional Road Trip Surprise Prizes where you will be able to enter for a chance to win a surprise prize. Each Road Trip Surprise Prize will last four (4) hours and take place on various unannounced days at various times throughout the Promotion Period. Road Trip Surprise Prizes will be featured on the homepage of the Website. Limit one (1) entry per Road Trip Surprise Prize per person, per e-mail address per day for the entire Promotion Period. Entries for the Road Trip Surprise Prizes must be received during the entry period specified when the Road Trip Surprise Prize is announced in order to be eligible for that day's drawing. Non-winning daily entries for Road Trip Surprise Prizes will not be carried over to subsequent Road Trip Surprise Prizes. Participants must re-enter for the next Road Trip Surprise Prize to be eligible for a chance to win a Road Trip Surprise Prize.
Daily Prize and Road Trip Surprise Prize Reminder Notifications: You may opt in to receive Daily Prize and Road Trip Surprise Prize reminder notifications throughout the Promotion Period via Facebook by "Liking" the BIC Soleil Facebook page at www.Facebook.com/BICSoleil. Road Trip Surprise Prizes will be announced on the Website and on the BIC Soleil Facebook page.
Grand Prize: During the Promotion Period, there will be one (1) Grand Prize awarded. You can submit an entry for the chance to win the Grand Prize once per day throughout the Promotion Period. Limit one (1) entry for the Grand Prize per person, per e-mail address per day for the entire Promotion Period.
Entries into the Daily Prizes, Road Trip Surprise Prizes and the Grand Prize drawings are separate, independent steps. Entries into one drawing do not automatically enter you into the other drawings.

4. PRIZES: GRAND PRIZE: One (1) Grand Prize winner will receive a 2013 BMW 128i Convertible.(ARV of $40,000). Specific vehicle model, color and options to be chosen by Administrator. Cash Alternative Option: Grand Prize Winner may elect to accept cash substitution prize of $32,000 in full and total substitution for the Grand Prize. (Cash will be awarded as a check made payable to Grand Prize Winner).

DAILY PRIZE: CMA MUSIC FEST VIP TRIP: Ten (10) prize winners will win a VIP trip for two (2) to the CMA Music Festival from June 7, 2012 to June 10, 2012 in Nashville, Tennessee (ARV of each trip is: $3,000). Trip includes roundtrip domestic coach airfare, ground transportation to/from the winner's home; to/from Nashville airport; to/from hotel, hotel accommodations for four (4) nights and five (5) days (double occupancy) and tickets to the 2012 CMA Music Festival. If the Winner lives within 100 miles of Nashville, and air travel is not required, a transportation stipend of $200 will be issued, and cash difference will not be awarded. Winner and guest must be able to travel for five (5) consecutive days from June 6, 2012 to June 10, 2012 or as required by the Sponsor to accept the prize. All other expenses not expressly stated herein are the sole responsibility of the winner and their guest. Winner and guest must travel on the same itinerary. A minor may accompany Winner as a guest only if the Winner is the minor's parent or legal guardian. Minor must be accompanied at all times during Trip by minor's parent or legal guardian. Winner and guest must sign and return a Travel Release (as provided by Sponsor) before any ticketing of travel occurs. Hotel accommodations will be selected and arranged by Administrator. Prize cannot be sold, transferred or bartered in whole or in part and no substitutions or cash equivalents allowed, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize of comparable or greater value. All details of the Prize shall be determined solely by Sponsor. If the event is cancelled or postponed for any reason after travel is arranged, balance of trip will be awarded in full satisfaction of prize, and no additional prize will be awarded. In the event that the Winner and/or guest engages in behavior that (as determined by Sponsor in Sponsor's sole discretion) is inappropriate, threatening, or illegal, or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the Trip early, in whole or in part, and send the Winner and/or guest home with no further compensation.

5. DAILY PRIZES / ROAD TRIP SURPRISE PRIZES / GRAND PRIZE ENTRIES: Sponsor and its subsidiaries, parent companies, affiliates and/or agencies are NOT responsible for lost, late, incomplete, illegible entries, computer errors; failures in servers or other connections or communications; or other errors of any kind nor for any injury or damage to an entrant's or other person's computer related to or resulting from participation in the Promotion. Sponsor will not be responsible for any alert or notification failure resulting in a lack of entry or inability to enter. All entries become the sole property of Sponsor and will not be returned or acknowledged. All entry information will be held and used in accordance with Sponsor's privacy policy www.feelthesoleil.com. In the event of a dispute concerning who submitted an email entry, the entry will be declared to have been made by the authorized account holder of the email address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
6. WINNER SELECTION/ODDS OF WINNING: Winners of Daily Prizes and Road Trip Surprise Prizes will be randomly selected from among all eligible entries received at the end of each daily entry period. Grand Prize will be randomly selected on or about August 13, 2012. The odds of winning depend on the number of eligible entries received. No substitution, transfer or cash redemption of prizes permitted, except at Administrator's discretion. All federal, state and local taxes, and other charges, if any, are the sole responsibility of the winner. All potential winners of prizes with an ARV of $600 and above will each be issued a Form 1099-MISC. Limit one (1) Daily Prize or Road Trip Surprise Prize per person-/family/household. Winners of one (1) Daily Prize or Road Trip Surprise Prize are also eligible to win the Grand Prize.
Winner confirmation is subject to verification and compliance with these Official Rules. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of the Official Rules. A "screen shot" is not evidence of winning a prize. If any prize becomes unavailable, Sponsor reserves the right to substitute another prize of equal or greater value. By entering Promotion, entrants agree to abide by and be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects. Entrants who do not comply with Official Rules or who attempt to interfere with the Promotion in any way shall be disqualified.
If by reason of a printing, computer, production or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.
Daily Prizes/ Road Trip Surprise Prizes: Other than notification of the CMA Music Festival VIP Trip, winners will be notified via email, within seven (7) days of being drawn. Notification e-mails to potential winners of prizes with an ARV of $600 and above will also include an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release, which is subject to verification, and must be executed and returned within seven (7) calendar days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected. All Daily Prizes/Road Trip Surprise Prizes will be shipped via UPS within six to eight (6-8) weeks time upon verification of winning throughout the duration of the Promotion unless otherwise indicated.
CMA Music Fest VIP Trip: Winners will be notified via phone and email on or about May 8, 2012. If potential winner cannot be reached or fails to respond for a period of two (2) calendar days following first attempted notification, prize will be forfeited and an alternate winner will be randomly selected. Potential CMA Music Fest VIP Trip winners will be sent via email an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release, which is subject to verification, and must be executed and returned within two (2) calendar days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected. Winner and guest must travel on the same itinerary and are responsible for obtaining all required medical clearances and travel documents. Failure of Prize Winner and guest to obtain proper travel documentation may result in cancellation and loss of travel prize. Sponsor will not replace lost, mutilated or stolen tickets, travel vouchers or certificates. A minor may accompany Winner as a guest only if the Winner is the minor's parent or legal guardian. Minor must be accompanied at all times during Trip by minor's parent or legal guardian. Winner and guest must sign and return a Travel Release (as provided by Sponsor) before any ticketing of travel occurs. Travel and lodging are subject to availability; certain restrictions may apply. Meals not included. All taxes are the sole responsibility of Winner. Prize cannot be sold, transferred or bartered in whole or in part and no substitutions or cash equivalents allowed, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize of comparable or greater value. All details of the prize shall be determined solely by Sponsor. In the event that the Winner and/or guest engages in behavior that (as determined by Sponsor in Sponsor's sole discretion) is inappropriate, threatening, or illegal, or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early, in whole or in part, and send the Winner and/or his or her guest home with no further compensation.
Grand Prize: Potential winner will be notified via phone and email on or about August 15, 2012. If potential winner cannot be reached or fails to respond for a period of seven (7) calendar days following first attempted notification, prize will be forfeited and an alternate winner will be randomly selected. Potential Grand Prize winner will be sent via email an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release, which is subject to verification, and must be executed and returned within seven (7) calendar days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected. Winner is responsible for all taxes and expenses (excluding sales tax), including but not limited to: registration, title and license fees, insurance, additional equipment and all other costs incurred in registering, titling or using the car. Vehicle is delivered solely with the express limited warranties provided by BMW and winner shall look solely to those entities for any warranty issues. Sponsor in its sole discretion may elect to substitute another car of a similar look, color or model and style in the event of scarcity due to limited production or unavailability for any other reason. Potential Grand Prize Winner may be required to take delivery of the vehicle at their home or a car dealership, designated by Administrator, within the fifty (50) United States and the District of Columbia. Vehicle delivery and location to be determined by Administrator. Vehicle will be released only upon proof that the winner is 18 years of age or older at the time of entry and satisfactory proof of insurance. Failure to accept possession of vehicle within ten (10) days of notification of availability may result in prize forfeiture. Prize cannot be sold, transferred or bartered in whole or in part. Sponsor reserves the right to substitute a prize of comparable or greater value. All details of the prize shall be determined solely by Sponsor.
7. ELIGIBILITY: Promotion open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. U.S. federal, state, and local laws and regulations apply. Persons in any of the following categories are NOT eligible to win a prize: (a) Employees or agents of Sponsor and Administrator and their parent companies, subsidiaries, affiliates, distributors, subsidiaries, advertising and promotion agencies, (b) individuals engaged in the development, production or distribution of materials for the Promotion; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All federal, state and local laws and regulations apply. Void where prohibited, taxed or restricted by law.
8. PROMOTION INTEGRITY: Individual Entry Only. Every entry submission must be manually key stroked and manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or promotion service) will be disqualified and transmissions from any related e-mail or IP addresses may be blocked. Entries submitted by any other individual or any entity originating at any other Internet web site or e-mail address, including but not limited to commercial promotion subscription notification or entering service sites, will be declared invalid and, as such, ruled ineligible for this promotion. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of the Official Rules. A "screen shot" is not evidence of winning a prize.
Sponsor reserves the right to suspend or terminate the Promotion, if in Sponsors sole discretion; the Promotion becomes infected or otherwise corrupted. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, incorrect or inaccurate entry information, computer bugs or viruses; failures in servers or other connections; lost or interrupted or unavailable network, miscommunications, failed phone or hardware or software transmission failure or loss; delayed or corrupted data transmissions; garbled or jumbled transmissions or for any other error of any kind, whether computer, technical printing, typographical, human or other, relating to or in connection with the Promotion including, without limitation, errors which may occur in connection with the administration of the Promotion, the announcement of the prize, the processing of entries or in any Promotions, related materials, or inaccurate transmissions of or failure to receive visit information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Promotion or any element thereof. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed 'void' by the judges.
9. GENERAL CONDITIONS: Entry constitutes permission for Sponsor to use any prize winner's names, city and state of residence, and likeness for publicity, advertising and all other purposes, in any and all media now or hereafter known, including the Internet and social networking sites, without further notice or compensation, except where prohibited by law. Participants release and hold harmless Sponsor, and its parent, affiliates, subsidiaries, vendors, advertising and promotion agencies, and all others associated with the development and execution of this Promotion, and the respective officers, directors, shareholders, agents and employees of the foregoing (collectively, the "Released Parties") from any and all claims, actions, injury, loss, liability or damages of any kind whether direct, compensatory, incidental or consequential, with respect to, or in any way arising from, participation in this Promotion or acceptance, possession, use or misuse of the prize including, but not limited to, liability for personal injury (including death) and property damage or loss. This Contest is governed by the laws of the United States and the State of Connecticut, without respect to conflict of law doctrines. As a condition of participating in this Contest, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Connecticut having jurisdiction.
