Furious staff LOCK family inside restaurant for refusing to pay full 17% tip after bad service

A Houston family were locked inside a restaurant and the police were called after they refused to pay the full 17% tip.

That is the amount the restaurant adds to parties of more than five diners, but Mark's complaint was that the staff were rude, their drinks were not refilled and mistakes were made on their orders.

'We asked her, could the gratuity be removed?' said Marks.
'Could we give our own tip?

'I asked the police officer twice, maybe three times, is it against the law if we don't pay the gratuity and he never gave me a straight answer.'

As someone mentioned, there was a similar case not long ago. It comes down to the language. If the menu states that it's a mandatory "service fee" or similar phrase, patrons have to pay it. However, if it states that "gratuity" is mandatory for parties of x or more, then it's not enforceable since, by definition, gratuities are based on patrons' choice.

So, if the restaurant's menu says gratuity, they would be in BIG trouble if they illegally detained a patron for refusing to pay it.
Egg-xactly - therefore, there is no such law in any State that would uphold this for any restaurant if they took a person to court over something like this; as they listed it as a "gratuity" - which means it is up to the customer's discretion as to what amount they wish to "leave their server".

This is what OP simply cannot get through his warped wrapped up thinking because he "once was a waiter" Doh

Lol......I noticed after visiting many forums and waiters' forums that many ppl in the restaurant industry (or formerly) live in another world with regards to tipping. To many of them, the standard tip of 15% is a minimum despite how bad the service is.

My niece still is a waitress, although she is employed full time - she does it for the extra cash. We have gone to the restaurant she works at on the weekends. One night we were there in her section and, a huge party came in - she said to us oh gawd, I'm going to get a crappy tip from them, just looking at the people in the "party" that sat down. We asked why, and she explained it to us ( I won't go into it). Although this restaurant states 18% gratuity for large parties such as what sat down; there was nothing she was able to do about it, but smile and give them great service. We ended up being there until they left, and she came over and said yep, got a crappy tip, around 10% for a party of 10 people. We left her a 20% tip that night, which is around our norm; unless we get really bad service and/or the meal is really bad, and they do nothing about it.

But I will NOT pay 18% gratuity simply because it states it; it's up to me what I choose to pay, and if they insist they want to add that on - I look at them and say fine - but you are going to sort change your server - and I will then put that tip on my Credit Card - and not leave a cash tip. Otherwise, that server would have received 20% and it would have been "cash". So they screw themselves over it they are really insistent upon this nod

I understand some servers get screwed with larger parties - that's all in the game of being a server - it can't be helped - but doing it long enough like my niece - they seem to recognize when a large party comes in - whether it's going to be a "bad tip party or a good tip party" for some reason. Dontknow why.

It says gratuity on their menu (see below) but it has an extra 't' in it. Would that exempt them? Scratchchin

Early May seems like a strange time for the nuts to be dropping from the trees.
