Hardee’s The Amazing Spider-Man Video Game Instant Win Game ~ 7/15/12 (cup code + AMOE)

Promotion Period will begin at 10:00 AM Eastern Time ("ET") on May 21, 2012 and ends at 11:59:59 PM ET on July 15, 2012.

Open to all individuals who: (A) Have supplied Sponsor with a valid e-mail address; (B) Are at least 18 years of age or older at the time of entry; and (C) Are legal residents in the 48 United States or the District of Columbia, excluding the states of New York and Rhode Island.

Two ways to enter Promotion:

(A) Entry with Purchase: During the Promotion Period, visit any participating Hardee's Restaurant, purchase a specially marked 40 oz. The Amazing Spider-Man Video Game fountain beverage of the Entrant's choice, while supplies last, obtain a unique 8-digit code on each Cup, and play the game via text message or by logging on to the website as follows:
a. Text message entry: Text Code to "87963". Entrants are limited to five (5) Game plays per day per person per mobile number during the Promotion Period.

b. Website Entry: http://www.hardees.com/theamazingspiderman Entrants are limited to five (5) Game plays per day per person per e-mail address during the Promotion Period.

(B) Alternate Method of Entry Without Purchase: To obtain Complimentary Codes without a purchase:
a. Between May 21, 2012 and July 2, 2012, an Entrant should legibly write his/her e-mail address, complete name (first and last, no initials), complete valid street address (P.O. boxes will not be accepted), city, state and ZIP code, date of birth and telephone number on a properly stamped 3½" x 5" postal card and mail it, postmarked no later than 7/2/12, to: Hardee's The Amazing Spider-Man Video Game Instant Win Game Code Request, P.O. Box 251328, West Bloomfield, MI 48325, and five (5) Codes will be e-mailed back to the Entrant at the e-mail address provided on the card, which he/she may use to play the Game during the Promotion Period. REGARDLESS OF WHEN CODES ARE EMAILED BACK, A PARTICIPANT MAY NOT ENTER OR USE THE CODES BEFORE 5/23/12 at 10:00 AM ET. NOTE: Mail-in requests that are sent in an envelope rather than being written and sent on a properly stamped 3½"x 5" postal card will not be processed and will not be eligible to receive a Code. Mail-in requests must be handwritten and no mechanically reproduced or photocopied requests are permitted.

b. Between July 3, 2012 at 12:00 AM ET and July 15, 2012 at 11:59:59 PM ET, an Entrant should go to http://www.hardees.com/theamazingspiderman_amoe and follow the instructions to request a Code and five (5) Codes will be emailed back to the Entrant. Each Code is valid for one (1) Game play throughout the Promotion Period.

Additional Game Plays: Uploading a photograph: Each Entrant can earn one (1) additional Game Play during the entire Promotion Period by uploading an original photograph striking your best Spider-Man "pose". Examples of valid entries can be found in the "Photo Gallery" of the promotion Website. The photos are required to be uploaded to http://www.hardees.com/theamazing...otogallery and must satisfy the following guidelines and restrictions: Each photograph: Must not exceed 10 MB in size; Must comply with all limitations, restrictions, guidelines and provisions in these Official Rules; Must be in the one of these formats: .JPG, .JPEG, .PNG, or .GIF; and Must not contain any identifiable people; Must be original, created solely by the entrant, not be plagiarized or have been previously published or previously won a prize or award; Must not have been submitted previously in a promotion of any kind; Must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity, copyrights, trademarks or other intellectual property rights; Must not disparage the film "The Amazing Spider-Man," the character "Spider-Man," and any related characters, Sponsor or Sponsor's products and/or brands, Administrator, or any other person or party affiliated with the administration of the Promotion; Must not in any way, either visibly or otherwise, contain any brand names, logos or trademarks other than those of Sponsor and parties affiliated with the Promotion; Must not contain personally-identifiable information of any person other than entrant; Must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous;
Must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and Must not contain material that is unlawful, in violation of, or contrary to, the laws or regulations in any jurisdiction where the entry was created.

LIMIT: Regardless of the method of entry used to enter the Promotion, an Entrant is limited to entering a maximum of six (6) Codes per day (five (5) cup codes and one (1) code received by uploading a Photo). After an Entrant enters using one (1) code for submitting a photo, he/she will be limited to entering a maximum of five (5) Codes per day for the remainder of the Promotion.

Note: The food prizes will expire on July 30, 2012 and must be redeemed by such date. Also, the PlayStation Network Voucher Code for in-game Character Skin to The Amazing-Spider Man™ Video Game will not be available until June 26, 2012 and will expire September 17, 2012.

PRIZE FULFILLMENT: Prizes will be mailed to the Winner's address that he/she provided when registering for this Promotion. Allow 4-6 weeks from the end of the Promotion for delivery of a Prize. If a potential Prize winner is found to be ineligible or not in compliance with these Official Rules, declines to accept a Prize, or if a Prize is returned as undeliverable, then the Prize may be forfeited. In the event that a potential prize winner is disqualified for any reason or is deemed to have forfeited the prize, the prize will again be made available to the eligible pool of entries and another winner will be selected at a randomly computer-generated time as long as a credible pool of such entries will exist. If a credible pool of such entries does not exist, Sponsor will award any forfeited or unclaimed prizes valued at $25 or more to an alternate winner by random drawing from among all remaining eligible entries. There will be three (3) random drawings after which the applicable prize valued at $25 or more will remain un-awarded. All forfeited or unclaimed prizes thereafter will not be awarded.
