Guessing technically speaking you can win the phone and gift credit, but you don't have to use them. For example you could win the item and gift card--and pawn them off to someone on ebay/craigs.

The reason they use that language is for people who have never owned a smart phone before. If you just slip in the sim card from your previous phone and don't have a data plan they will auto charge you for one. Even if you don't use any of the data features on the phone. Think they are just trying to give people a heads up about that.

When I first won a blackberry bold AT&T charged me for a dataplan without warning, despite never using a data feature. The phone detected the new device and screwed me. If that sounds like a jerk move, its because it is one.
