OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
1. Eligibility: Open to legal U.S. residents twenty-one (18) years of age or older and the age of majority in their place of residence as of date of entry. Employees and their immediate family members (parent, siblings, children and spouse, and person residing in the same household whether related or not) of Verizon Wireless ("Sponsor") and its parent and affiliated companies, subsidiaries, and advertising and promotion agencies, and all other companies associated with the Sweepstakes, and their respective agents, officers, and directors, and all individuals, including, but not limited to, consultants, independent contractors, so-called "temporary employees," former employees and interns (and their immediate family members) who have, within the past six months, performed services for Sponsor, are not eligible to enter or win. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and anywhere outside of the U.S., and where prohibited by law.
2. Sweepstakes Period: The Sweepstakes begins on August 31st, 2012 at 6:00 p.m. PST and ends on September 14, 2012, at 6:00 p.m. PST (the "Sweepstakes Period").
3. Entry: To enter the Sweepstakes, entrants must do the following during the Sweepstakes Period: Post a message ("tweet"™ on Twitter.com) using the hashtag #RAZRMAXX2Share and in 140 characters or less tell the Sponsor who you would share your second DROID RAZR MAXX with. Once a completed tweet is posted to Twitter, using the hashtag #RAZRMAXX2Share, and containing a response to the question about who the user would share their second DROID RAZR MAXX with (the "Tweet Submission") the submitting Twitter user will be automatically entered in the Sweepstakes.
All entries must be received by 6:00 p.m. PST on September 14, 2012. Limit one entry per Twitter user account. Once submitted, entries cannot be withdrawn. Incomplete entries are void.
4. Tweet Submission Requirements: To constitute a valid Entry, a Tweet Submission shall comply with the entry requirements of Section 3 of these Rules, and shall not:
1. Exceed 140 characters;
2. Contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilation, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age) illegal (e.g. underage drinking, substance abuse, computer hacking, etc), offensive, threatening, profane, or harassing;
3. Contain content which would be derogatory and/or insulting of any other Tweet Submissions, Verizon Wireless and/or its parent company and/or any of its affiliates, Verizon Wireless users, or any Verizon Wireless' products or services; and
4. Contain content which refers to and/or is complimentary of any competitors of Verizon Wireless, or which is complimentary of and/or refers to any product competitive with any product of Verizon Wireless.
All entries become the sole property of Sponsor, and receipt of such entries will not be acknowledged. Incomplete entries are void. Any individual who attempts or otherwise encourages, directly or indirectly, the entry of multiple Tweet Submissions or enters false contact information under multiple identities, by wireless phone, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries, as determined by the Sponsor, will be disqualified. Mutilated, lost, illegible, or incomplete entries will be deemed ineligible and disqualified. Sponsor reserves the right to reject any Tweet Submissions submitted in connection with the Sweepstakes for any reason, and any Tweet Submissions so rejected will not be entered into the Sweepstakes.
Any individual who attempts or otherwise encourages, directly or indirectly, false contact information under multiple identities/accounts, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries, as determined by the Sponsor, will be disqualified. In the event of a dispute, entry information will be declared made by the authorized account holder of the Twitter account posting the Tweet Submission at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to a Twitter account, as applicable.
5. Random Drawing: There will be one random drawing on or about September 17, 2012 for the Sweepstakes. One winner will be selected at random from all eligible Tweet Submissions received during the Sweepstakes Period. The random drawing will not take into account the content of the Tweet Submissions eligible for the drawing (except insofar as the submissions will be required to be deemed eligible based on the Tweet Submission requirements set forth in Section 3 of these Rules), and the content of the Tweet Submissions will not impact the selection of a winner from the pool of eligible Tweet Submissions. The winner will be notified by Tweet and direct messaged via Twitter. The decisions of the Sponsor are final and binding on all matters related to the Sweepstakes. Winner must respond to such notification within 24 hours after the notification is sent or an alternate winner(s) may be selected from the remaining eligible Tweet Submissions. Winner may be required to provide proof of eligibility, including some or all of the following information: name, address, city, state, zip code, telephone number, date of birth, and e-mail address. If it is determined by Sponsor that the Winner is not a legal U.S. resident, eighteen or older and the age of majority in his or her place of residence as of the date of entry, the Prize will be forfeited and an alternate winner will be selected from the remaining eligible Tweet Submissions received.
6. Prize: There will be one (1) Prize awarded during the Sweepstakes Period for a total of one (1) winner. The Prize will consist of two (2) DROID RAZR MAXX by Motorola devices (Model number MOTXT912M) with an approximate retail value ("ARV") of $1299.98. All federal, state, and local taxes and fees, including income tax, sales tax and license fees, and any other expenses arising out of the receipt and use of the prizes, are solely the responsibility of the
winner. Any difference between the stated estimated value of a prize and its actual value will not be awarded. Winner agrees to accept prize "as is." Prize is awarded WITHOUT WARRANTY OF ANY KIND by Verizon Wireless, express or implied, without limitation. Wireless service is NOT INCLUDED with the Prize, and any and all fees and costs associated with the activation and use of wireless service on the Prize is the sole responsibility of the winner.
7. Odds of Winning: Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
8. Restrictions: Prize is nonrefundable and nontransferable. Sponsor is not required to offer any substitutions, cash redemptions, or alternative to prizes awarded under this Sweepstakes. Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Recipient of prize must have a U.S. mailing address. The prize awarded is subject to the restrictions and limitations noted in these Official Rules, on the prize and/or included with the prize.
9. General Entry Rules: Sponsor, together with any co-sponsor and sweepstakes administrator, and their respective parents, subsidiaries and affiliates, advertising and promotion agencies, suppliers (including all prize providers), printers, and distributors, and the respective officers, directors, employees, representatives and agents of each and any other person or entity related in any way to this Sweepstakes (collectively "Sweepstakes Entities"), are not responsible for late, lost, incomplete, misdirected, or damaged entries or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in this Sweepstakes, or for any printing errors in these Official Rules. If for any reason (including infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of Sweepstakes Entities occurs that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes) the Sweepstakes is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes, and select the prize winner(s) from entries received prior to the action taken, or as otherwise deemed fair and appropriate by Sponsor. Sponsor reserves the right to prosecute any fraudulent entries to the fullest extent of the law. At Sponsor's sole discretion, entrants, winners and guests who do not comply with these Official Rules or attempt to interfere with this Sweepstakes in any way may be disqualified.
An attempt by an entrant or any other individual to deliberately damage any web site related to Sponsor or the Sweepstakes or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from such entrant to the fullest extent permitted by law.
10. Release and Indemnification: By entering, entrants of Tweet Submissions and winner(s) agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final for
all purposes hereunder, and agree: (1) Sweepstakes Entities may use (unless prohibited by law) their names, likenesses, images, photographs, voices, cities/states of residence, biographical information, and Tweet Submission for advertising, trade and promotion in any media or format now or hereafter known, including on the Internet or via wireless application protocol, without further compensation, permission or notification, except where prohibited by law; and (2) to release, hold harmless and indemnify Sweepstakes Entities from and against any and all liability, damages or causes of action (however named or described) with respect to or arising out of either (i) entrants' participation in the Sweepstakes or in any Sweepstakes-related activity; or (ii) the receipt, possession, or use or misuse of the prizes awarded in the promotion, including but not limited to any claims for damage to property, personal injury or death, or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery. Winner will be required to complete, sign and return an Affidavit of Eligibility and Publicity/Liability Release or prize may be forfeited and awarded to an alternate.
11. Rights in Submissions: By submitting a Tweet Submission for this Sweepstakes, each entrant hereby grants to the Sweepstakes Entities the exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such Tweet Submission, or any portion thereof, in any media now known or hereafter devised. Each entrant authorizes the Sweepstakes Entities, and any entities affiliated or in privity with the Sweepstakes Entities, to utilize, for eternity and in any manner the Sweepstakes Entities see fit, and to make derivative works of such materials. Each entrant agrees that the results and proceeds of such use shall become the property of the Sweepstakes Entities and shall be freely assignable by the Sweepstakes Entities, and that the Sweepstakes Entities and its assignees and licensees shall have no obligations whatsoever to entrant. Each entrant agrees and acknowledges that participation in the Sweepstakes, including, without limitation, the entrant's decision to provide the entrant's Tweet Submission to the Sweepstakes Entities for purposes of this Sweepstakes, shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, or other special relationship between the Sweepstakes Entities and entrant, does not place the Sweepstakes Entities in a position that is any different from the position held by members of the general public with regard to elements to the entrant's Tweet Submission, and that only contracts, express or implied, between the Sweepstakes Entities and entrant is as set forth in these Official Rules and the release forms.
12. Miscellaneous Conditions: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of New Jersey, without giving effect to any conflict of law provisions thereof. By participating in the Sweepstakes, entrants agree that any and all disputes which cannot be resolved between entrant and Sponsor, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the County of Somerset, State of New Jersey, having competent jurisdiction, which court shall apply the laws of the State of New Jersey without giving effect to any conflict of law provisions thereof. Any personal information supplied by any entrant to Sweepstakes Entities will be subject to Verizon Wireless' privacy policies posted at http://www22.verizonwireless.com/privacy.
13. Winners' List and Official Rules: You may request the names of winners and official rules by sending a self-addressed, stamped envelope by December 1st, 2012 to: The Verizon Wireless DROID RAZR MAXX by Motorola Twitter Sweepstakes, 100 Southgate Parkway, Morristown, NJ 07960.
