In Michigan by law every item, except 25 items of the stores choice, have to have a price tag on it.
How they enforce that I don't know. The "scan award" is based on each unique item that is priced wrong.
Last week at CVS they overcharged me on 2 items (different UPC codes). Even if it is 2 Speed Stick, but different scents they are penalized.

However..this store refused to pay on the 2nd item, stating the law was per receipt, not per item. They did not know what they were talking about.
The cashier knew I was correct, but the manager would not budge.

I kept asking her if she was sure she did not want to follow the law and issue the scan award.
Asked her again..Still said no.

So I said fine..I need printout of my transaction, your name etc..

Filed a small claims suit against them yesterday.
By not following the scan law they will get fined $250 to me along with court costs.
I just wanted the $5

Gave her a chance..told her what would happen..she looked at me like I was an idiot.
This is why..I do not shop at that CVS very often.

Does your state have something similar?

MI - If an item scans higher than the marked price, you ge tthe difference back plus $5. One $5 reward per item per receipt. Multiple of the same item on the same receipt only earn one $5 reward for that item. ~ellemdee

NC- No award to consumers who find pricing errors. However, you can report problems to the Department of Agriculture, which can fine the store up to $5000. Here are the statutues. ~sweetpeanc

Is is $5 per item? My two items were on two receipts plus I am not from a scan law state. No scan law in MS, where I currently live. I had the chance to see it in action on my vacation in MI, on Sunday. It was a nightmare trip to Wags but ended up in my favor. I think the manager was seriously irritated with me by the time I left. The Bertolli didn't print RR. The HT rang wrong @ 11.49. The HT IVC didn't work. They had last weeks tag for 1.99 All up still and it (obviously) scanned at regular price.

You scan law folks are fortunate. They couldn't care less in MS if something rings or is priced wrong. Dontknow

It is up to $5 per item. 10 times the difference up to $5, minimum $1.
The stores try to get around it by coming up with various reason such as:
Limit 1 award per reciept
or my favorite "You must leave the store to qualify for the award"
Target is the worst, with K-mart not far behind.

One time, Target gave me grief about using 3 coupons (yes only 3)..I have had numerous problems with that place and was needless to say ticked off!

So I said fine..Went down the HBA Deodorent aisle and bought every scent of speed Stick the had because they were ALL priced wrong by .52 cents.

So 20 speed Sticks at $2.99 (should have been $2.49) = $59.80.
Purchased all of them without any coupons

Went to customer service and got back the .52 on each one = 10.40

OOP was now 49.40

Then got a $5 scan award on each one for $100. Made $50 in 20 minutes
Then I said to the boss.."Maybe next time you will let me use the 3 coupons I had wanted to used in the first place"

I was livid..so was he..
I practically dared him not to give the award on each, but he knew what I would do..

In Connecticut (I no longer live there so it may have changed and I don't know that it has) they do not need to have price tags. However, if a consumer item is advertised as being on sale with a reduced "sale" price, and it scans at a higher price, the store is required to give you one of that item for free. I did take advantage of that a few times when I lived there. There are some exceptions to this rule and I don't want to give wrong info, so I won't get into that.

I would like to find the correct info on this also.
I do know that most supermarkets used to advertise here that if it scanned wrong they would give you the item free.
I have done this at supermarkets many times.
but, they always give you just one of the wrongly scanned items free.
I wonder if the law is that they have to give em all to you?

My mom absolutly loves this law. I'm not as brave as her and got stepped on by a Walmart employee a few years back because she said the scanner law doesn't work on clearence items. I haven't shopped there since.

I shop at Kroger for groceries, and my trips usually involve less than 40 items. However, on every trip they overcharge me for at least 3 or 4 items. Sometimes it's an overcharge of a couple dollars each item.

They've never given me this bonus, and they hem & haw & give me a hard time just about giving me the difference. This week I'm going to whip out this law printed out when they overcharge me. It will be fun!

Scan law does apply to clearenced items as long as they are ticketed.

I have sued wal-mart over this one..they always lose.

A good place to start would be your respective state Attorney Generals, as that's the office that's typically in charge of consumer protection (which the MI scan law falls under).

I'm in MI and I have been told by cashiers "you can't get the $5 unles syou leave the store first and com back in" and "you only get the $5 if you notice the error before you leave the store". I even had a store tell me that it doesn't count if the item was below $5. I had a $3 item scan wrong and they just gave me the item for free and made it sould like it was a better deal than getting $5. I was in a hurry and didn't have the time to argue with them. It helps to carry around a printout of the law with you.

As far as multiple items, you should get the extra $5 once per misscanned item per receipt, so if you buy ten of the exact same item, you'd get the difference back for each of the 10 items, but you'd get the $5 one time. If two different items scan wrong, then you'd get the $5 twice, etc...

Ha! LMAO!! laugh out loud This is sooo funny. Good for you! It sounds like something I would want to do, but wouldn't have the guts. worship And of course, I love that you price matched each deodorant before getting your scan award. There's a true SlickDealer there, yessiree!

Am I the only one that thinks that this is misusing & abusing "the intent of the law". Hopefully the judge will use some "common sense" & dismiss these small claims cases, thus costing the filing fees for these frivolous lawsuits. If the store was willing to sell the items at the correct price & GIVE $5 for any inconvenience, that should be more than enough. After all we're talking about an honest mistake by the store not some illegal activity in order to scam the customers.

Also I think what you did at Target was borderline criminal. To USE the law for personal gain is wrong & to come on this board to boost about it is shameful. You get the items free, the store pays you $50 for the privilege of giving them to you & you can justify that....how?...$50 to massage a bruised ego? The money that you received was not paid by the manager or the store, it is a part of "the cost of doing business" & is passed on to all of us, the consumers.

This thread has caused me to question my own ethics with couponing in general. Like everyone else on here I want to save as much money as possible & I enjoy the challenge of "getting one over" on the stores but I personally would rather pay retail than thought of as a "scammer" or even worse a "thief".

No holier-than-thou speech, just some observations & opinions.
