It was new. You are very right about the reason they are refurbished, and after reading several reviews, I am going to pass on this. Seems like I was rather lucky in my experience.

Don't be tempted. Considering Amazon recently had a brand new 40" TCL, using Samsung S-PVA panels, for $269 shipped (not black friday either), I'd recommend that everyone take a pass. Walmart...
