I received mine 32GB, it has few minor scratches in the back. It was 4.1 and modem firmware 06.15.00 I was able to unlock in few mins. Working great on T-Mobile NW. My spouse is very very happy :-)

OK to answer my own question, I had to go to the AT&T store and ask them nicely for a SIM card. The guy eventually gave me a SIM. Then I loaded it into the ipphone and could see my firmware (5.0.1)...

I would not even consider 3G, because you cannot update to iOS 5. Even if theres a work around, it will be slow as snail balls. Unlike 3GS, which is one of the best iPhones that were created, imho....

FYI Gamestop doesn't refurbish. They get used iPhones, clean them up, and resell them. Can't compare Apple certified refurbished prices to these.
