I think that's the classic argument - that it's just a digital medium that you're getting the data from, rather than the airwaves, and so it should constitute fair use.

3 htpc's, hdhomerun, cheapo nas like the DNS 323's or the HP server sold not too long ago. The htpc's can be used older dual core machines +5450 cards. I have a similar setup as is. Been loving it...

I think if someone gets sued for downloading TV shows (rather than, say, sharing them) it will be tested, as it strikes me as a very weak law with some major holes.
