you should be able to keep your current plan.. I had a similar issue when I went from the 3gs to 4s.

Call ATT, they are known for overcharging for no reason in the billing. This might turn out to a be a new ploy milk you for more money for a the data service when you upgrade.

I'm guessing because it's 4G now. Iphone 5 isn't worth it to me and I'm a big apple guy. I have the 4s and am happy with the 3G. No need to get new docks etc. Apple slipped with the new pin.
