Don't tender the check if you don't want to. They won't take you to small claims court. Even if they do, just show up in court, and tell the judge your wife didn't have the right to make the offer....

School is important, if you like the house, go for it.
Install the AC and just clean the pool for now and cover it till you have budget to upgrade it.
AC, fence are required now, pool is not a must.
