Only thing I have noticed is that some of the third party drives are not set up with the correct partitions to play original Xbox games.

I think I remember reading that people have been banned from XBL for using non-OEM HDDs.

I haven't found anyone claiming to have actually been banned for using a third party HDD, just a lot of people arguing about whether or not it violates the ToS.
