You're at least half wrong. They have been winding down the lifecycle of the 2/3DS for some time now, but with one of the more expansive and impressive libraries (including the massive DS catalog) in portable console history, interest remains aplenty. This is a great time for people to jump in, the games are as affordable as they'll get and the consoles are readily available at deep discounts from people jumping to Switch.

I have bought a couple of refurbished 3DS like these before, directly from Nintendo. They come in a generic white box, and at least the ones I got were all completely flawless. In their description they say that they might have some blemishes, but I found that to be not the case.
With their 1 year warranty I think this is an excellent deal. The production of all 3DS has ceased already, as far as I know from a wholesale contact I have. They are only making 2DS now. I would grab at lease one of these.

I purchased a galaxy N3DS XL from the Nintendo Store, it was perfect for about a month. The screen went black and it would remain on even when closed. Customer service was pleasant and replaced it without any questions. Returned it and got another one within a week. Had this one for over a year, no problems. The Nintendo Store is a perfect shop for refurbished items and would highly recommend buying from them.

These usually come in generic boxes with 1 year warranties. Judging by local store inventory, I'd say new 3DS games will clear out of physical stores by this time next year.

The only thing on the physical release calendar is Persona Q2. I don't think we'll see any more first-party games like Kirby or anything. For my purposes, 3DS is now a legacy console. I still play my Gameboy Advance all the time though so this doesn't bother me in the slightest.

I was going to say the same thing about the release calendar. Even Persona Q2 was a surprise and other than that and Shovel Knight: King of Cards (which was supposed to have been released earlier this month but has been delayed several months yet again) there is nothing really notable out there last I checked. I agree with you about first-party releases and Kirby's Extra Extra Epic Yarn may end up being the last one we see (physical anyway, barring any new Nintendo Selects) so to me the 3DS is unofficially end-of-life as well.

I don't even think we'll see any more Selects. I did just pick up Mario & Luigi Paper Jam from Walmart for a cool 9 bucks though, so keep an eye out 3DS fans. They're looking to trim their inventory it seems.

Probably an inventory thing. New 3DS is the least in-demand model and thus they don't have as many refurbs to clear out. That's my theory anyways.
