IIRC, that's a known scam. The business owner signs up to accept all card types, gets a reduced processing rate, and turn around refusing Amex cards because they are under the (erroneous) impression Amex has higher fees. Stick these crooks with a Visa Infinite or MasterCard World Elite and show them what real high interchange fees really are like (as per their merchant agreement, no discrimination is allowed within networks like Visa and MasterCard, they are subject to being blacklisted if not in compliance)

Yeah because you want to punish them so that Amex can make more and you will ultimately pay more when they pass the cost on to you in their prices lol. There is no free lunch.
If not being able to pay by CC bothers you to the point that you take your business elsewhere, that is your right and the merchant loses business. It is a trade off they have to make. Personally, I have pizza delivered and it almost never use a CC for that stuff and pay cash. Not because it is easier, but because I do not trust the people working in most places like that to not rip off my CC info over the phone. It is not like I am driving to the pizza place to pick up my pie to save a couple of bucks on the delivery tip, but that is me.
There is absolutely NOTHING illegal about not accepting CCs or not wanting to accept certain types of credit cards. At worst, it might be a breach of contract with the CC processing firm by the merchant for not living up to the terms of the contract they agreed to, but that would be a civil matter not a criminal one and it likely would never be enforced anyway as what firm is going to sue a small merchant for such? The legal fees would be more expensive than anything they could hope to get. Worst that likely would happen is Amex would pull the merchant's ability to process their card and the CC processing firm would drop the merchant as a client or charge them a higher rate.
And if your overall point was that cash businesses are trying to dodge taxes by not reporting it, that may or may not be true in any given situation, but is completely besides the point. If a merchant wants to cheat on their taxes, they will and not accepting a CC is only really indicative of them not wanting to pay a fee. The IRS famously went after pizzerias by tracking the number of boxes they bought and matching that up to the number of sales they reported. Not accepting credit cards does eliminate that paper trail, but there are often others as such that can be tracked if they choose to do so.

Yeah you never know, but the chef or cook or cashier could do the same thing so if you worry about that sort of thing you really will go nuts imo. That said, if you have it delivered, don't be so foolish as to not tip the guy a few bucks as that would be sort of asking for it the next time lol. Just common sense I know. In this day where you get delivery on everything, it would seem unavoidable unless you decide to cook everything yourself and never order out.
It reminds me of major stores like Walmart or Best Buy who I have found numerous times to have the wrong store hours listed on their website. No one gets around to updating it.
No wonder Amex is disliked by many small businesses.
