it most certainly is not a grey area lmao. You can be banned for using such hardware. It is part of game and console TOS and EULA.

Really? Then why does Sony have their own branded version?
Seems weird that it is against the TOS when Sony has a branded one.
That's just an overpriced game pad/mouse combo. It doesn't tell the system that it is a controller, which is the argument re:cheating. It would function as a keyboard and mouse. The controller emulator gives you access to controller-specific tweaks that games have like aim assist, which combined with mouse aiming is practically aimbot and ruins competitive integrity.

This controller can be used for any game on PS4 and PS3 even if the games does not support K&M. No game on PS3 has this support to my knowledge so it goes to say that this acts like a controller and not K&M to the console. Also Fortnite has a checker to see if people are using these devices and blocking them. This Sony one is also being blocked. Another example that this is acting as a controller.
Finally you can see in this youtube video that CoD Warzone is showing the controller buttons in the UI and not the keyboard:

I'm a long, long time PC gamer but it seems all my friends have moved to consoles. I just can not adjust to controllers, would love to join up with them and play again.

If it was seen as a K&M then the UI would show the keyboard controls.
I am not saying that using these devices are okay, just that they do not violate any of Sony's policies.
