So here's the deal. Apparently Lowe's, in desperation to compete with the Home Depot BOGO tool deals, has increased their "every day price" of certain DeWalt combos in order to proclaim that you now get a "Free" gift tool when you buy the combo at the newly inflated price.

In the example of the DCK28D32 combo kit, Lowe's changed normal non-sale "Everyday Low Price" of the combo kit from $199, to a fake inflated $299, and then "slashed" in a made up sale to $249 in order to suggest it is on sale from $299.

In our case, the local representatives at the store had not yet engaged what appears to be deceptive pricing practices and still had the normal every day non-sale prices on the shelves ($199). So I took a picture of it and asked the manager about it.

The manager of course let me have the XR combo + the free tool ($200 value) for $199+tax out the door without any fuss at all. YMMV, but this is pretty straightforward. (and great DEAL for newest brushless XR's instead of Atomic or MAX!)

(Btw, I'd recommend getting the ROUTER or JIGSAW for the free tool as these are $199/each tool-only, usually hard to find in store, and they are the brushless XR versions as well!)

The FTC ~233.1 has specific rules and guidance against deceptive pricing, specifically dealing with "former prices" like this:

So here's the old "every day price" rack sticker and barcode. (image attached)

If your Lowe's has already "updated" their price sticker to this new BS inflated $299 $249 price for the combo, then I guess this means your Lowe's manager has already engaged in the rules FTC guides against. FTC 233.1(c) presents some examples that are pretty close to this situation. Print it out, show it to the manager and ask for their opinion. Odds are you're going to get the "deal", but YMMV.

I have seen costco and many other outlets constantly doing this. The Childrens Place that comes to my mind where they keep increasing/decreasing the price and then give discounts accordingly. Did not know about FTC violation in that. Thanks for sharing.

I think there's no problem increasing prices with market conditions (though $199 to $299 is a little suspicious) the problem is when you are seemingly doing it so that you can advertise that you now get something "FREE" with the newly inflated price.

The truth is, it is not free at all... it is costing you nearly $50 more than the old "Everyday low Price".

I guess the FTC also has some rules about the words "FREE" and Lowe's does say this extra tool is a "free gift" when you purchase the combo kit at the newly inflated price.

Good. Call them out on it every time. At the very least, request for them "settle" with you on the spot by honoring the real pricing.

I do not know if there was an old lower price for the 2 battery combo, but I see in other threads people were complaining about suspiciously high prices on different items that qualify for this "free" gift tool sale.. $199 for the battery combo Confused, $297 for many of the single tool + battery combos Confused, etc.

Regarding this 2 battery combo kit + free tool. I did bought about 7 kits of those, price matching the batteries to $99 (farmstore.com) and $129 (fastenersinc.net). So that was one hell of a deal. $99 for 2 5.0 Ah batteries + a free bare tool. I did that for more than one store, only one manager did argue with me, but all the others did agree.

Note: the batteries were on sale on the websites, but not anymore.

Their policy doesn't state what stors they can price match to. It just says any online retailer.

Wow. That's crazy that they honored both the price match + the free tool. That's a painful loss-leader of a deal for them to accept if you got a $200 "free" tool on top of the batteries for $99+ tax.

I don't have much experience with it, but it does seem like Lowe's managers are pretty honorable about honoring these things once it is brought to their attention. I just think it's crappy for Lowe's to have jerked the prices around like this. I guess deals like yours are the equalizer for their sometimes evil ways. Smilie

Actually, if the manager follows their terms and does the research they won't.
Lowes specifies online *only* retailers, since they have a brick and mortar location they will only match locally to that store.
Been through that technicality before with them unortunately

Yes, as expected. The deal is not about prices in the system not being updated. The deal is about pointing out the deceptive pricing practices to a manager - (raising regular prices) in order for Lowe's to claim you are now getting a "free" gift tool. At $249 "sale" price, you would actually be paying $50 more than the old "every day low price" (old regular price) in order to get a "Free" tool as a gift.

First of all, price adjustments like this are done at the corporate level and pushed down to the stores so saying your local store manager is guilty of violating FTC rules around prices is absurd.

Second, promotions like this are in partnership with Dewalt so if there were violations to any rules then DeWalt would be equally at fault.

Third, Dewalt does not currently list a MSRP on their website. The $199 "everyday" price that was listed previously for Lowe's could have been a negotiated price between Lowe's and Dewalt for certain period of time. That could have expired, new promotion started with new price.

All major retailers are visited yearly by Weights and Measures for pricing audits. None of the claims here are in violation of FTC rules.
