Mine came with new packaging stickers covering them, but they had pretty noticeable scratches and should have been replaced.
The battery was also completely depleted when I got it and by my estimate, only gets about 80% longevity compared to a brand new one.
The lenses can't really be polished without taking the anti glare coating off and you absolutely NEED that coating if you wear glasses.
But you can get an external USB battery to get over the runtime gripes.

I think what happened is these were pulled from being sold, partially due to the 'rash' problem and then a silicone cover was thrown into the box and then they were sold as 'refurbished'. My friends 128GB model has what appears to be the same exact foam as mine, and it also came with a silicone cover in the box.
EDIT: For what its worth, no scratches anywhere and I did have a firmware upgrade that had to be done after I powered it up. If you had told me it was brand new, I would definitely believe it. Battery life also seems on par with my friends 128GB model, so, I'm guessing mine was stock that couldn't be sold at retail since the 128GB units were out.

1. They offer free replacement that won't cause rashes, though I'm not sure if refurb units quality.
2. Apparently people are saying these aren't really "refurb" and you'll get a new update face cover thing anyways that won't cause rashes.
Battery may be iffy as it is an earlier model. And 64gb storage may be eaten up pretty quick. Good for a secondary heat set just multi player though.
