Where do you see factory renewed? It says "New" multiple times and I don't see any reference to factory renewed? Also their factory renews generally have a return policy , these ones say final sale.

It's literally the first sentence of the item description.
I see what you're referring to. I don't think it's correct. I'm on desktop and it doesn't show that. When I switch to mobile, If you click on where you see factory refurbished, it opens up what you see on desktop, which is the product info with no factory refurbished mentioned.
When you go to the Factory Refubished version (why would they have two listings for the same item? Unless one is new and one is refurbished?) the main product page specifies refurbished.
More than likely these are new and it's a bad listing by Bose. Either way, it's good to be aware of that it COULD be refurbished. But if that was the case - I'm not sure why Bose would list the item twice (they are pretty good with their listing) and these have a different return policy than ALL of their factory refurbished.
"Our SoundSport Free Earbuds were very popular. Unfortunately, we have now run out of stock and we're unable to fulfil your order. However, we wouldn't want you to miss out…
We have a great save and we would like to send you a pair of the newer Bose Sport Earbuds, Certified Refurbished instead of the SoundSport Free, for the same price!"

Wow they listed them as new rather than refurbished. Scummy...
Edit: quoted wrong person.

I suppose if I receive refurbs, I'll dispute it.
