After reviewing the BBB website, this might be a good option for all of us with canceled orders.

If we all file a complaint, Total Wireless might be forced to honor the pricing. At worst, they'll have to respond to every single complaint. Those of you who were canceled at the lower price of $99 and received the $149.99 iphone should definitely file this since you have proof they actually did this. You might be able to get the difference back.

I'm sure they'll eventually get more iphone 11's so maybe we'll get the next batch.

https://www.bbb.org/file-a-complaint/search

According to their website, this is their address:
Total Wireless
Attention Executive Resolution Department
9700 NW 112th Avenue
Miami, FL 33178

This also matches the address listed in the BBB Search.
Responses:
1. No (Yes tells you to file a review)
2. No for all of the questions
Fill in address and info
3. Asks about desired resolution. In my case I wrote "Delivery"

Description:
I placed an order for a refurbished iPhone 11 for $99.99 on July 14, 2022.

The seller accepted my order and gave me a confirmation number: Order Number: _______

On July 16, 2022 the seller started selling the same item for $149.99. The seller subsequently started filling these orders and eventually cancelled my order on 7/20/22.

I am requesting that I receive the item I originally ordered at the price I ordered it at.
--------------------------------------------
Desired Resolution: Delivery
(If you have proof, take a screenshot of both of your orders and upload it here as well. Also include the cancelation email too.)

You can't force someone to sell you something at certain price. No law supports it

It's about the fact that they offered it at a lower price and then later offered it at a higher price then canceled my order at the lower price even though it was earlier.

always purchase with Paypal, which has buyer protection. Otherwise, no one will take care of you in case something goes wrong with their phones...
My C.C. company took care of it no problem. Just uploaded the original receipt and email of cancellation and it was done. Easy. I'm not going to sit and wait forever for a refund to come.

Is it LEGAL to charge and not ship the product? Aren't online retailers suppose to charge the credit card only when they ship the product? Revenue is only recognized for the seller when the product ships. Otherwise companies would create thousands of orders at the end of the quarter to inflate their revenue and never ship them afterwards.

I've called TFW twice and they just say that the card was not charged. They don't even talk about a refund. Same thing in their cancellation email. It sounds like they are NOT even initiating a refund.

I'm guessing almost everyone will have to file a dispute or do a chargeback. They are not refunding on their own.

The people who used Paypal are screwed. You need to open a dispute and Paypal will wait for seller and buyer to settle amicably. They will only intervene after a certain period.

WIth a direct CC - it would have been a quick refund.

I bought on 7/16 for $149 and it shipped 7/19. We should all return our $149 phones with a note saying to use them to fulfill the $99 orders.

Exactly, unless I know for a fact I won't have any potential issues with a purchase. I'll never ever use PayPal as the middleman for a transaction.

The merchant can do whatever they want, when you place the order you already agreed with some T&C, they have right to not selling you anything

That may very well be true, but I'll let the BBB decide. If I'm wrong, I'm out a few minutes of time. If I'm right, I should get my phone. I'm willing to take that shot.

If they took your money and said item was shipped out, then that's scam and illegal. But if they charged you and ship the item out after certain of time, that's totally fine, it depends how their billing system work.

They charged the CC. After a week+, they cancelled the order.
They had no intention to ship, and now they are NOT giving a refund.
So at best, they are holding my $$. Imagine holding money for thousands of orders - even for a month - that's a TIDY profit.

No hurt to try.
BBB is only a mediator, if Tracfone doesn't give a damn to BBB, or they say it's out of stock, then really nothing we can do.

Well - I did it for 2 reasons.
First, not to expose my credit card to a shady company like TFW.
Second, paypal had 5% CB with Discover and 3% with Paypal MC.
