1. Sponsor: The Taco Bell Coin Drop Promotional Game ("Game") is sponsored by Taco Bell Corp. ("Taco Bell" or "Sponsor"), 1 Glen Bell Way, Irvine, CA 92618.
2. Eligibility: The Game is open only to legal residents of the fifty (50) United States and the District of Columbia, who are (i) sixteen (16) years of age or older at the time of participation in the Game; and (ii) registered Taco Bell® Rewards Program account holders on the Taco Bell® mobile app (each an "Eligible Member"). Void in all other territories, possessions, and commonwealths, and all other countries and where prohibited. 3. Participation, Terms & Conditions, and Rewards Program Terms: An Eligible Member who participates in the Game is a "Participant." Participant is subject to these Official Rules and the decisions of Sponsor, which are final and binding on all matters relating to the Game. 4. Timing: The Game begins on July 11, 2023 at 7:00am PST and ends on August 14, 2023 at 11:59pm PST ("Promotion Period").
5. How to Play:
a. NO PURCHASE OR ROUND UP NECESSARY.
b. During the Promotion Period, Eligible Members may obtain one (1) virtual Taco-Bell®-branded token coin ("Coin") necessary to play the Game ("Gameplay") by one of the following methods once per day:
i. Order a Taco Bell® product through the Taco Bell® mobile app; round-up the total cost of the order to the nearest dollar; and donate the additional monetary amount to The Taco Bell Foundation, a 501(c)(3) tax exempt public charity that educates and inspires the next generation of leaders through programming like the Live Más Scholarship and the Local Grants Program. ii. Log into their Taco Bell® Rewards Program account on the Taco Bell® mobile app; where directed, navigate to https://www.tacobell.com/coin-drop-amoe; complete the required information fields (first and last name, email address, phone number, date of birth); agree to these Official Rules; and submit a request for a Coin without purchase or round up/donation.
c. LIMIT: One (1) Coin per calendar day credited to Eligible Member's Taco Bell® Rewards Program account regardless of method of obtaining a Coin.
d. During the Promotion Period an Eligible Member must visit the Taco Bell® mobile app; sign into his or her Taco Bell® Rewards Program account; and click where prompted to initiate Gameplay. The objective of the Game is to drop a Coin in a virtual vessel and attempt skillfully to land the Coin on the indicated platform. Eligible Members may practice Gameplay by clicking on "How to Play." Participant will be able to manipulate the platforms using an interface. If the Coin falls to the bottom of the virtual vessel without coming to a full stop on the indicated platform, the Participant loses and a message will indicate that the Participant is not a winner. Successful completion of the Game will result in a success message.
e. All potential winning Gameplays are subject to verification by Sponsor or its agent, whose decisions are final and binding.  A Participant is not a winner of any prize, even if the mobile app interface should so indicate, unless and until Participant's eligibility and the potential winning Gameplay have been verified by Sponsor. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. Any Gameplay that occurs after the system has failed for any reason is deemed defective and void, and it will not be honored. All Coin acquisition and Gameplay must occur during the Promotion Period. Coin acquisition can occur on a different calendar day than Gameplay (except on the last day of the Promotion Period). Eligible Members may obtain multiple Coins during the Promotion Period. Coins do not roll over after Promotion Period and unplayed Coins are void. Coins have no cash value and are nontransferable.
f. Automated Gameplay is prohibited. Any use of automated devices for Gameplay is subject to disqualification.
g. Normal Internet and/or mobile device access and usage charges imposed by Participant's online and/or mobile service provider may apply.
6. Rewards: A verified winner of the Game will be presented with three (3) Taco Bell® food item options from which such winner has the choice of selecting one (1) reward ("Reward" or "Reward Item"). The selected Reward Item will be stored in the winner's Taco Bell® Rewards Program account for redemption on the Taco Bell® mobile app. Selected Reward Item expires fourteen (14) days after the date awarded ("Redemption Deadline"); expired Reward Items are void. Subject to the conditions set forth below, the Reward Items are: (i) Cinnamon Twists (approximate retail value or "ARV" $1.00); (ii) Crunchy Taco (ARV $1.79); or (iii) Bean Burrito (ARV $1.79). Reward Items are subject to fulfillment conditions: Fulfillment of a particular Reward Item is subject to store participation, availability, and hours. Taco Bell reserves the right to substitute an item of equal or greater value due to unavailability. Reward Items shall be issued and redeemed only through the Taco Bell® My Rewards platform on the Taco Bell® mobile app until the Redemption Deadline, irrespective of Promotion Period, for in-store/drive-thru pickup orders (except as otherwise may be designated by Taco Bell in Taco Bell's discretion with respect to delivery orders placed directly on the Taco Bell® mobile app) at participating Taco Bell® restaurants in the United States and District of Columbia, while supplies last. Check hours of the Taco Bell restaurant at which winner intends to redeem a Reward Item. Taco Bell is not responsible if the Taco Bell restaurant at which winner intends to redeem a Reward closes before the Redemption Deadline. Rewards are nontransferable. Rewards cannot be used for web pay-ahead, pickup, or delivery (except as otherwise designated by Taco Bell in Taco Bell's sole discretion with respect to delivery orders placed directly on the Taco Bell® mobile app). Prices may vary and any difference in announced approximate retail value and restaurant or app menu prices will not be provided. Rewards may not be combined with other rewards, discounts, or offers. No product or ingredient substitutions, upgrades, add-ons, cash redemption, or alternatives will be allowed unless permitted by Sponsor at its sole discretion. Participating Taco Bell restaurant manager reserves the right to deny free food and/or beverage to any person the manager reasonably believes has engaged in fraudulent activity. Any applicable taxes related to a Reward are the responsibility of the Reward recipient. Sponsor's and all restaurant managers' decisions are final regarding redemption of Reward Items.
7. Administration: The round-up option within the Taco Bell® mobile app may not be available at all times. Sponsor expressly reserves the right to amend, suspend, or terminate the Game at any time. Administration of the Game is at the sole discretion of the Sponsor. Any questions relating to eligibility, these Official Rules, or any other questions concerning the Game will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto. Participant may be required to sign documents in connection with the Game as determined by the Sponsor, in its sole and absolute discretion. No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Game or reproduce or distribute any portion of these Official Rules to their members.
8. Other Terms and Conditions of Participation:
a. Release and Waiver/Limitation of Liability: Participant agrees to release, defend, indemnify and hold harmless Sponsor and its affiliates, parents, subsidiaries, retailers, sales representatives, distributors and franchisees, and each of their officers, directors, employees and agents ("Promotional Parties"), from and against any and all claims, demands, losses, promises, causes of action, injuries, damages and/or liabilities, that may arise, directly or indirectly, in whole or in part, from participation in this Game, or receipt or use or misuse of a Reward or any activity related thereto. Under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, punitive, incidental, special, consequential, or any other damages, other than for actual out-of-pocket expenses, excluding attorneys' fees and court costs. All causes of action arising out of or connected with this Game shall be resolved individually, without resort to any form of class action. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Promotional Parties will not be responsible for Acts of God, acts of terrorism, civil disturbances, weather, strikes, lockouts, labor disputes, fire, acts of government, work stoppage, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, or any other natural disaster outside their control. Sponsor is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender or by any of the equipment or programming associated with, or utilized in, the Game or the Taco Bell® mobile app, or by any human error which may occur in the transmission or processing of the Game or any part of the Game (including, but not limited to, the Taco Bell® mobile app). Sponsor is not responsible for lost, late, misdirected, or corrupted Coins or incomplete or otherwise corrupted Gameplays. Sponsor assumes no responsibility for damage caused by computer virus or otherwise, to any computer resulting from Participant's access to the Game website or participation in the Game. If for any reason the Game is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Game, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Game. Persons found tampering with, or abusing any aspect of, the Game, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified.
b. Privacy: Personal information provided or made available in connection with the Game is subject to Sponsor's privacy policy available at https://www.tacobell.com/legal-no...acy-policy.
c. Choice of Law: Participant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, consumer's rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. Participant consents to the exclusive jurisdiction and venue of the federal, state, and local courts of Irvine, California for the resolution of any disputes related to the Game.
d. Severability: If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal, or unenforceable by a court, arbitration panel, or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
e. Primacy of the Terms & Conditions: In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Game-related materials, on the Taco Bell® mobile app, or on the Game website on the one hand and these Official Rules on the other hand, these Official Rules shall prevail, govern, and control.
