Most likely, these are the defective ones that Sony took back when fulfilling their own warranty, then liquidated those to Secondipity.
Don't get me wrong though, literally everything else Sony I've gotten from Secondipity might as well have been new.

Might as wait for their ebay store sale
I got my XM4s there, and while I loved them, a little more than a year later the battery life on one of the earbuds would only last about 1.5 hours and the other was about 4 hrs. I used them almost every day for minimum of 5 hours. Glad I had the warranty and they cut me a check about a week after I sent them in for repair estimate.
With the refund, I got the XM5s, and I almost prefer the XM4s since the XM5s are a bit small and it's more difficult to physically put them in my ears lol. It hasn't been a year yet but I'm already noticing the battery life isn't as good as when I first got them.

The headphones have issues too. Just search up "XM4 left ear noise". I I already got it swapped since I still had warranty.
I had my current set for 1 year now and BOOM, it started happening again. Out of warranty now.
There is an extremely extremely loud screeching sound that comes out of the left ear randomly when you have ANC on. It doesn't happen when ANC is off. I searched it up and the "fix" is to turn off ANC for 5-10 minutes, then turn it back on.
Two sets, both had this issue. When you Google it, it's not an uncommon issue either.
