OK I did a study on this since I bought fake Airpods Max from an eBay seller. I refused to return it since these MOFOs would just resell it to some other sucker. I bought one of these "Like New" and will be watching the detail on this to check. Here are the clues I used for an eBay dispute, so hopefully this helps someone else who's concerned:
1) Serial number may be a legitimate Apple serial (based on the lookup on Apple's site). This is highly deceptive and often confuses most people.
2) Box and headphones show many signs of counterfeiting. Here are some tell-tale signs:
- On box, the sticker at bottom of the box shows: Compatible with latest iOS and iPadOS devices, Apple Watch or Mac. IOS iPadOS, Apple Watch Mac. This last line is translated into 4 languages in the original and IOS is definitely not misspelled.
- OEM box has AirPods Max Sky Blue with Blue Headband. Counterfeit box as follows: Headphone Max Space Gray with Black Headband
These are not authentic AirPods Max headphones. They are plastic cups on the ear, not "beautifully anodized aluminum cups feature a revolutionary mechanism that allows each cup to rotate independently and balance pressure" (https://www.apple.com/airpods-max/).
- The LED light is blue and red when pairing, while legitimate Apple AirPods Max are actually amber and white. https://support.apple.com/en-us/119838
- A tell-tale functionality with fakes it does not support Automatic Switching between Apple devices (Bluetooth connect with two devices and hand-off automatically when playing music or video etc.): https://support.apple.com/en-us/104988

Whats there process for assuring the used product isn't a swap out with a fake? Do they validate authenticity somehow? I've heard these are notorious for that

I agree. I got the purple version for my sister and they turned out to be fake. Serial numbers didn't match with the box as well. Wrong model model listed on the device vs. original box . Also "made in china vs assembled in Vietnam"

I personally wouldn't buy used/returned AirPods from Amazon, or anywhere really, because the odds of them being counterfeit is very high.

Be prepared for these to have bee linked to a prior AppleID and the 60-day countdown on AppleCare+ to have already started. Got burned this way on a previous pair Frown

Looking at these pictures I am a bit confused. Aren't they supposed to say assembled in Vietnam? That's what mine say that I got from BB new and came sealed in a box and checked out fine on apple website. In your pictures the actual headphones picture appears genuine. Is the outer shell metal? Another test is to rotate / press the buttons and those should be smooth without any clicks - fakes click. Additionally if you press the head band sides together, with real you cannot but the fakes have a lot of flex and will press together easily.

Perhaps I misunderstood the pictures?

I have a purple on order from Amazon too that will be delivered on Friday and I will update.

I believe the main point there is different serial numbers on the box and on the headphones. Though, I agree, that the airpods on the pictures seem to be the real ones. Looking forward to inspect mine which are coming.

i had legitimate ones and they were shiet for the gym

volume was not loud enough and ANC is weak for the size

it was more cumbersome to charge and it's not compact at all

no idea why these are even worthwhile years later
