yes. in the past i read an instance where someone said that they bought a game key cheap online, seemed fine until their account was banned by nintendo. they called nintendo and had to explain and show receipts of where they bought the game. the customer service unbanned them but told them to stick to legitimate sources from now on.
TLDR: risk of account ban

Do these resold key have any risk to the Nintendo account?
Ie does Nintendo ever take action against their use?

edit: Per comments below, Nintendo does crack down sometimes and bans accounts. if this happens to you in the future I hope you'll circle back and comment. I doubt anyone will have issues immediately.

SD gets about 5% so they love these grey market sellers.
