Some states limit kids even more, like to ebikes capped at 20mph. NJ has banned ebikes for all unlicensed riders, after a kid ebiked into traffic and died. (And all parties voted for it. "Think of the children!")
Furthermore, this form factor is not good for a bicycle where you pedal. That big, wide seat? Yeah, that's crap for pedaling. Do you see any way of adjusting that seat for pedal comfort or power? Absolutely not. Notice how slack the chain is in the "action shot" on level ground. Not a great sign for keeping the chain attached.
Lastly, this "bike" screams "I wish I were a motorcycle." Triple-tree front end? Way too heavy for any bicycle. Oversized tubular steel frame? Same. Square seat in a fixed position? Only for 100% motor use. Big ol' eyeball headlight? Absolutely motorcycle-wannabe.
This thing all but has a sign that says "Do any cops want to harass me over my unlicensed e-motorcycle?"

The legal limit for an ebike tops out at 28mph and 750W (1hp). Anything above either speed or power is a moped or a motorcycle, both of which require licenses.

There are waay too many laws to name as they vary from state to state and even city to city.

I am a USAF veteran living in Montana, and our outdated laws have ebikes capped at 20MPH, Mopeds at 28mph , and the rest are required to be certified as an electric motorbike.
You are required to have a driver's license to drive a moped in MT (so some older middle schoolers may be able to drive a moped). And a motorcycle endorsement for an emotorcycle.

Longer answer is it depends on if the trails are public or private. Private trails you can strap a rocket to a skateboard and do whatever. Public trails vary....a lot. Some places will forbid motorcycles (like this) and ATVs but allow class3 and below ebikes. Some "e-mtb" trails will let you have a 30hp motor as long is it is powered by batteries and there are pedals somewhere but others observe the 28mph cap.
You know many states that license middle schoolers for motorcycles?
For the states I've bothered looking up ( California, Indiana, Kentucky, New York, New Jersey, Missouri & Michigan) it is a motorized vehicle that requires registration, plates, driver's license, etc.
But that assumes it has a VIN and even can be registered, which it doesn't, so it is an "offroad-only" motorcycle which cannot be used on public roads.

The state of Washington, which limits ebikes to a max of 750W and speeds under 28mph for class 3. Class 1 & 2 are capped at 750W & 20mph.

If this were a moped you would need a motorcycle drivers license to operate it except this is not a moped in Washington as they are limited to 2hp (1500W) and 30mph, sp 40mph is right out.

So this is a motorcycle in Washington, which requires license, registration, plates, insurancw, etc. But it won't be street legal by default so you can't get those things. To make it street legal go through this process

Note that all lamps, hydraulics and tires must have appropriate DOT certifications to be road legal for the inspection to pass.
Next state: New Jersey. ALL e-bikes in New Jersey will require the rider to be 15+ and have a license. Plus any ebike that goes over 20mph needs an insurance policy (that doesn't exist).
But the kicker is that it also makes online advertisements or sales of any 2-wheel motorized device that can do more than 28mph illegal for at least 12 months.

Also tons of riding all over parks and grass and ripping up the sod. There are lots of entertaining threads around about this kind of riding -- and the smaller gas powered bikes you see all over, too.
