It doesn't say because I can not find even one place where it says it's included. Being it's from Walmart's overstock/trash division, it's going to be YMMV at best but definitely not a given if it doesn't say it.
The description clearly says "The included 20V battery offers over 30 minutes of runtime and fully charges in only 2 hours.

Ok, they copy and pasted the general description with that buried one-liner but they didn't include any of the photos (or description) that says what's included, as found on the Walmarts listing that was $77 for the actual full kit.
I would not put it past this again, outlet/returns part of Walmart to have taken out the new batteries and missed that line in the general description when they listed this...but so be it.

If you look at the picture where the battery is installed it shows a 4amp battery on the vacuum.
It also says kit in the title and the condition is New not open box which would lead me to believe its new. Walmart blew these out in October 2025 for 77 right before Hart announced they wont be selling tools anymore. Im just putting this out there in case the people who owns Hart who probably wont be able to find batteries eventually want to grab a cheap tool while its around for the tool and extra battery. if for some reason its a listing error they can just return it. Its a no Brainer to me.
Listed as Brand New condition and "kit"
Not sure why there is so much doubt on it being what it claims.
Must be your first time shopping with VipOutlet, given that part is confirmed to have happened (selling open box/broken items/returns) as new, given their past dealings here with other items.
As for the listing, I already mentioned the oddities of why they didn't include most of the pictures or details in the Walmart listing.
In addition, if you look at the bullet points on the Walmart ad and the VipOutlet ad, every other line is copy and pasted besides what's included.
Might you get the battery (and the charger that isn't even mentioned anywhere) ?...maybe but if I was them wanting to list just the tool (and carelessly miss that one description line)...that's probably how it would be done.

It also mentions nothing about the charger regardless of that one battery line, if you want to go back and forth.
Point being: this is from VipOutlet, so it's best to not assume anything.

Walmart item listing shows 4ah battery, charger, vacuum, and filter. Seems good the price if you're into HART.
Keep in mind HART is closing down, so replacement parts might be difficult to source. Might be wise to pre buy some filters now.
I doubt it's an amazing vacuum, but the swappable replaceable battery is a plus.
