We just bought an all-stainless Maytag at around this price specifically because it didn't have that top rack -- it lets you put full-sized pots, Nalgenes, almost anything up there. I've used the top silverware racks before and didn't love them. Just be careful that it's really something you want because to me, it just felt like a gimmick just to add a new feature.

There's only so much room inside the standard box, choose wisely.

You might have had an older model. I have a newer KitchenAid (same as Maytag/Whirlpool) with the third rack and it allows taller items on the right side of the second rack. Mine also has an adjustable second rack that allows you to take height from the first rack although that might be a feature of the higher-end models (or KitchenAid).
Either way I own a lot of rental units and the Maytag/Whirlpool dishwashers have been quite reliable... Usually get 10 to 15 years out of them in a high use environment which isn't bad for a $500 dishwasher. I would say that the front control units tend to be more reliable than the top control units.

I have this dishwasher and it absolutely kicks ass! I paid way more for it, big sad.
