If the prices are not equal, it is not a bogo (only up until recently did bogo deals turn into mix and match that made the store or restaurant charge the more expensive item, if both items purchased had differing prices). You are being ripped off.
You are paying $10 for a cheaper product. Or increasing the price of paying more for each, if you divide by 2.
Bogo would mean 2 for $9.89, $4.945 each
You just increased each to $5 each. Why are you giving them $0.11 of your hard earned money?
And if you were planning on buying "anything" (drink and a side item), they just made you spend more than you would have (unless you did intend to buy more) to get a free item that cost less. They baited you.

I would ask the same. If you want to pay $10 for an item that is $9.89, go for it.
$10 on a free $10 in value product means you are getting 2 for $5. Paying $10 for a $9.89 product means you are increasing the value of the free product.
If you still think you are getting a deal, lol!
